There is a "no pay, no play" law. Look it up. In a case like this, you should be nice to the other person and see if they will pay for it. Their insurance will find out you didn't have insurance and the law will come into play. If you didn't insure your car, you shouldn't have been driving it. |

The driver who hit your car is liable for any and all damages to your parked vehicle. Hopefully, you took digital cam pictures of the accident and damage done (which inculdes the license plates from the other vehicle). Don't go by the offered insurance information handed you by the driver; the information may be false as a means to stall for time (a common con fraud king's favorite ploy).
Secure the police report and contact the insurance company listed on it and make a claim. |

In most states, the person who hit the car will pay if the car is legally parked. This is usually true even in no-fault states.
I hope you have a police report.
Get the name of the insurance company from the owner of the car that hit you. You can contact their insurance company to start the claim process. You should even be able to claim the cost of a rental car while your car is being repaired.
If the person that hit you is uninsured, this will complicate things a bit. You can go to small claims court. Bring with you the police report showing the other person at fault. Get a couple of estimates from local body shops to prove damages. But unfortunately, even if you win in small claims court, it can be difficult collecting, even when if you win. |
