like i said i was rear ended but, it was really rainy and i hit my breaks slid towards a car and was gona hit it and i switched lanes before it hit it and the guy in the next lane had about 2 car lenghts between us and he slammed his breaks and bearly rear ended me and im a 16 year old kid and hes a old man whos at fault??

you're going to be at fault for and unsafe lane change. he was going on minding his own business. you were driving too fast for weather conditions.

Normally the person that rears ends you is at fault, but you changes lanes into his, thereby cutting him off causing him to hit you, so you might be found at fault. |

Was an accident report made by a peace officer? if yes, it will most likely assign a finding of which driver was at fault. If one was made, you can obtain a copy from the police department that made the report. If no report was made, it can be hard to prove fault. The other driver can always say you pulled in front of him/her without warning. If you need more info send me an email. |

You may be found at fault. (Improper lane change) but the insurance company has the burden of finding fault for repairing the damages, not the cops. It's brakes, not breaks |
