I need help talking to him!?

my future husband is helping out a friend by letting him buy his car. His friend has no license and is currrently driving the car. My boyfriend has kept the car in his name, and the car is insured in his name. His friend is paying for the car and insurance, but if he sold the car to his friend he would not be able to keep the car because since he has had his license taken away that insurance would be too high.

Both our parents have said that if his friend get's caught with the car, that it will be our fault, because he does not have a license. If his friend got into an accident it would be my boyfriends fault because it's insured under his name and the car is in his name so he could go to jail, if that happend.

My boyfriend doesn't understand that. He thinks just because the car is insured, that the driver( His friend) is insured, but that is not true because he does not have a license. All his friend has to do is take the test, and pass, and pay like 100 dollars and that is it.

My boyfriend said that in six months to a year if he doesn't have his license he will take the car back and sell it to someone else. Which i know he won't do, he will make up more excuses.

So how do i talk to him in a friendly manner without him thinking that i am over reacting ?

Your fiance is pretty dumb for allowing a non licensed driver to operate HIS vehicle.

Since the car is in your boyfriend's name he is LEGALLY responsible for that vehicle. If your fiance's friend was to (I'll give you the WORST case senario) get into a car accident and kill someone, it would be not only the friend that would get in trouble, but your boyfriend would get in trouble as well.

When you own a car you are responsible of who operates that car, and the financial responsibility (meaning making sure your have insurance and current registration on the vehicle).

A NICE way to discuss this with your boyfriend may be more in terms of the way in which you care for HIM!
Tell him how much he means to you, and how you would feel if he wasn't in your life anymore because of him trying to be nice to someone who isn't even LEGAL to operate a vehicle. Do you want your boyfriend to go to jail or even RISK the chance of him going to jail? Each time your fiance's friend operates that car, his chance of going to jail or getting into SERIOUS trouble drastically increases!
If your fiance cares more about letting his FRIEND drive the car, then how YOU feel about this situation, he needs to reevaluate WHO he is marrying and YOU TOO! Someone who CARES that much for you to marry you SHOULD be considerate of YOUR feelings! :-)

The other driver would only be insured if he was a LICENSED driver WITH PERMISSION to operate the vehicle.

I'm sorry this is happening to you, but if he wants to continue to be a dummy after you tell him how much your CARE about HIM and you don't want HIM to have an increased risk of getting into trouble... then he is SO not worth it!

He should ask his agent. In most cases, while it is illegal to drive without a license, the insurance does follow the vehicle. Therefore, both your boyfriend and his friend would be covered for any damage/injuries the friend caused. His liability coverage will afford him this coverage. The problem he may have, is that he is not a listed driver. He needs to be since he is now a regular user. In most states, the insurance would pay out the compulsory limits, but cut back on any limits above that amount.

Your BF is a nice guy. A dumb - but nice guy. If the car is involved in an accident, they will sue both the driver AND the car owner.

If he hasn't listen to you now, ask if he will listen to you later (after marriage). I think you have bigger problems than the car. It seems like that is just an indicator of what is to come.

Your parents are correct. Your boyfriend is responsible for that car. If his Friend even gets a parking ticket that he doesn't pay your boyfriend will have to deal with the bench warrant. Friends and business do not mix well. If his friend doesn't understand then he isn't much of a friend then. I suggest either getting the car back or having it put in his friends name.

I have found that the best way to get something out in the open is to set time aside for a serious conversation where both of you can act like mature adults. The only way most people can hear that they are doing something stupid is in a non aggressive situation that makes them look at it in a third person point of view.

Actually, Your insurance does not cover anyone who does not have a valid drivers licesnes. He can get insurance without a license but it will not cover the car if he found driving. infact the car can be impounded by the police or if he has an accident the it would be a breach of contract and the drive would be at fault no matter who caused it.

Your boyfriend wouldn't go to jail if that happened, his friend would for driving without a license though. But yes, your boyfriend is totally responsible for anything that happens to that car. If he gets into an accident, the insurance won't cover any damages. But regardless of what you say, I think your boyfriend is gonna let him keep the car. My guess is that something will happen to make him take it back, one way or another. Don't stress out about it. If he wants to be a dummy, let him learn his lesson.
