they looked left seen a car was reversing 6-8 spaces up so put there car in reverse and run strait into my car behind the back door right to the back bumper totally crumpled my car, theres didnt look to b dented but paint was scratched with my paint on there car may of broken there tail light as some was stuck on my car. we pulled back in i was calm,shocked asked the kids if ok, looked at my car and said s*!t a few times! i asked the person why didn they look to the right? no reply for that question they said its not like they ment it they have insurance anyway and i have an attitude they will give me there details they did. I got quotes then called them a few hours later to ask who there insurance company was and a claim number, ranting they say it wasnt there fault and it should b 50/50 i think my car will cost alot more to fix. If i was really in the wrong i would pay for there car to b repaired but i believe i was not at fault. i have no insurance should i pay for there car 2 b fix

i did go and see the police and they said as they were not there they could not do anything to help and i was doing the right thing coming to see them then was told insurance will have to work it out i told them i didnt have any. I was then told to see a solicitor then it will go to court but the fees involved may cost more than the cars. The other person also went and seen the police not sure wot they said to them.

You should have gotten the police involved so a report could be filed. They would decide who was at fault but I'm sure you would get a ticket for not having insurance. |

It is very difficult to understand how the accident happened.
However, if you were stopped when the other party backed up, then they would be at fault for the accident. If you were both moving, then yes, I would say this is a 50/50 accident. You both failed to check your surroundings while backing. If there are no witnesses, you are going to have a tough time proving the other party was more than 50% liable.
Suggest you contact their insurance company, and file a claim. The insurance adjuster will investigate the loss and decide the percent of liability on each party.
Why do you not have insurance? The other party may come after you directly for the damage to their vehicle. You will be responsible to pay for their damages, based on your percent of liability. |

And of course the right thing to do would be call the police and get a report which would clearly show exactly what happened, but you chose not to do that. And I know why, you knew if you did YOU would get a ticket for driving uninsured.
If you happen to be in a state like California, you won't be able to prevail since you will be automatically at fault not having required coverage. If not, well, sorry, you're on your own. Call the other person's insurance and try to convince them it isn't your fault. Your word against theirs with no report. And why oh why did you back until you were just behind them in the first place?
Do me a favor, no matter what else you do today, get insurance and get legal. |

Did you not call the police? You broke the law! Failure to report an accident...The police will site whoever was at fault...you have nothing....You have no insurance? That's illegal too....What are you teaching your kids? |

Uhm NO you shouldn't pay for their car to be fixed. Just call their insurance company and deal with them directly.
It was their fault. It's a no-brainer. You should have called the POLICE when the accident happened, then you wouldn't be in this mess.
Furthermore, why don't you have insurance? It's illegal not to have insurance. |
