She got divorced in 2005.
Her ex-husband had 30 day to retrieve his property from her home after the divorce was finalized.
The car had been sitting at her home for over 3 years with no one driving it and her ex-husband never came to get it. I
saw it when I went to her house and asked if she was interested in selling it. She said yes and I bought it the next day (paid cash but have 3 witnesses).
Since I could not get the title notarized I asked her to do it. She sent the title to him in Kentucky and he has refused to sign it, notarize it, or send it back. I have the car, she has the money and he has the title.
What legal rights do I have to get the title? I was technically an abandoned vehicle since it was at her house for 3 years after the divorce.
Someone please help me.... thanks....

Legally the car is hers.
She obtained it in the divorce.
Her divorce papers state her ex had 30 days to retrieve ALL of his personal property.
It has been over 3 years.

Ask her to write you a bill of sale then go together to the tag office and ask that they reinstate you a brand new title. You'll pay a small fee and they might ask her to explain her situation and proof that she was married to him or that the have divorced. Anyways, it depends.. they might not even ask you all those questions. If you have the bill of sale you can have a new title made to your name. Sometimes they won't do anything and tell you "this is the law!" B.S.! You bought that care and it's yours!
In that case go to a third party agency like getnewtitle.com or other (google new car title). They might give you the title to the ex name again. In that case tell your friend to just sign it over to you. You don't have to go to the tag office or notary or whatever. It's very easy to do. |

The car is legally his. You shoudl never buy something from someone who doesn't own it (your friend). He could probably have the car reported as stolen and you could go to jail. |

Sorry, you have no rights whatsoever except to get a refund for what you paid. It wasn't her car to sell.
Give her back the car, get your money back, and realize only the owner can sell a vehicle. |
