I was hit by another car. Their insurance is denying the claim. WHat can i Do?

Well,,,this girl hit my car and ran. I, and a witness in another car followed the person who hit me,,as they were tyring to run. We, with the police caught her. SHe got ticket and all,,,and completly her fault. It was not her car. she was borrowing it. THe insurance company on her car was avoiding the problem,,and now they are denying the repair. My deductable for my insurance is more than the repair,,as all i need is a new bumper, but i should NOT have to pay for it. What is a good fast easy way to get their insurance company or the girl to fix it,,,preferably without going to cort. ANd i am in Florida.

And i have talked to my insurance company, nation wide,,and they said that the other company is not going to pay up,,and since my deductible is like $500,,and the repair would be like $300,,, then nationwide wont pay for it,,and if they did then my rates would go up.

More than likely the insurance you are making the claim against is for the vehicle, And since this person is probably not on the policy, they do not meet the conditions for coverage to be provided for an accident.

Or you are making a claim w/ the drivers company, and you should be making a claim w/ the vehicles company, since the insurance follows the vehicle, not the driver.

If you pay for the repairs on your car, since its under your deductible, your insurance company should still be able to collect the money back from the at fault party.

If they won't, you could take the driver to court, but that would be a long process, a judgement would be placed on the other driver, and theres a slim to none chance you would get anything from her.

You need to tell us why the other party denied your claim. Just because she hit and ran, does not make her automatically at fault for the accident. What are the details of the accident? Did they deny the claim because she was an excluded driver on the policy?

Edit - FL is a No-Fault state, but that has nothing to do with the damage to your vehicle. It relates to injuries and PIP coverage. Medicals are paid under your PIP coverage. You do not have to prove fault. Payments are paid regardless of fault. Hence, No-Fault.

according to your description, it sounds like you filed under her insurance company. insurance follows the car, you would need to file under ther boyfriends insurance. this is why the ins co is denying your claim. they do not insure the vehicle. lawnboy is right. florida is a no fault state, but that has nothing to do with liability, only injuries. there is always somebody at fault for an accident!!

Be persistant with the insurance company.
Threaten to take them to court and add in medical expenses.
You don't have to actually do it, but the threat should be enough to make them pay up.
If you haven't yet, call a more central number for the insurance company and speak with a supervisor and explain that you will take them to court if you need to.

You should be covered as NO FAULT, even though only carry liability. That is you can prove is not your fault. Always carry a camera. My insurance has a kit that includes a camera.

First have your insurance pay for it (thats why you pay your insurance co twice a year!) and then have them go after either the other insurance co or the girl herself. If you have the police report (hit and run - a misdemeanor) than you have the law on your side. Mention bringing in lawyers if you have to. Good Luck!

Your insurance company should be taking care of this, not you. After all you pay isnurance premiums for peace of mind in these kind of situations. Talk to them.
