i was hit from behind in my partners car which is fully com insured, i have a van which is also fully com insured... we were under the impression that because i was fully com i could drive the car but have been told by a third party that my insurance is commercial and i am not... we have yet to inform insurance company even though we have the other drivers details who has admitted liability.. will we be able to claim from his insurance even though i am not covered

Check your insurance documents. Mine lets me drive any vehicle, with the owners consent, but the insurance is limited to 3rd party. So if thats the case, your OK |

I believe as long as your partner knows that you had her vehicle, it should be covered. This is what I have heard but I don't know how accurate it is. Sorry I couldn't be of more help. Good luck! |

Look at the small print in your insurance document. I am no expert on commercial insurance but the key thing here is
a) is the vehicle covered fully comp or your partner!? If your partner has any driver covered on her policy you are fine?
b) if not then your insurance could quite very well say that you are covered third party to drive another vehicle.
The mistake most people make is that if you are covered fully comp on one vehcile they think they are fully comp on any but unless you have specifically asked for that form of insurance it is often the case that you are covered third party if driving any other vehicle.
I do believe though that if you are not covered by insurance you won't be able to claim as his insurance company will want to deal with your insurance company.
Just a thought maybe you could tell the other boke if you aren't insured that lets not go through the insurance companies call it £x pounds and forget it? He might just take the bait and you get some cash and he gets to keep his no-claims and you don't get reported for driving without insurance!

Check this out but I believe it is the car that is insured no matter who the driver is. And if you have been hit from behind it is automatically the other drivers fault and his insurance has to pay. |

Either his insurance should cover you because you were driving his car, or you insurance should cover you because, well they insure you. Your insurance should transfer to anything you drive temporarily. But in the end the guy who hit you insurance is the one that will have to pay. So you can skip your partners and your insurance and take the matter up with the other guys insurance. |

Usually commercial vehicle policies do NOT give driving other vehicles - for the reason that you could insure a 35cwt van and then drive a 44 tonne vehicle. If you have insured the van on a private car policy (it can be done) then you may (NB may) have driving other cars - this right does NOT accrue just because you have comprehensive insurance.
However the fact that you don't have insurance does not affect the liability of the other driver so you will have no problems making a claim from him.

If you want to be sure before filing, your boyfriend could call and say that he's thinking about lending you the car but he wants to se if you'll be covered in case of an accident. If the accident wasn't your fault though, you shouldn't have to worry about his insurance covering you. |
