If it was the other persons fault they will have to pay for your damage. In that case you will have to sue them. If it was your fault than you have to pay for your and their car damage. In my state..if your car is paid off you have to at least have liable ins and if you owe on the car you have to have full coverage. Plus if you get pulled over..you have to have proof of ins. nobody should be driving with no ins. Imagine if you where to get in a real bad accident. the other person can sue you for all you have. at least get liability. |

If the other driver was to blame and there was damage to persons or the property of third parties (not your car), then the Motor Insurers Bureau will deal with any claims under the Untraced Drivers Agreement. Any damage to your vehicle will have to be dealt with under your policy (assuming you are full comp) and, sadly, you can loose you no claims unless it is protected. However, it is an offence to leave the site of an accident without giving details and, if the accident was serious, the police may try and trace the other driver, particularly if they think his driving was not correct.

Check with your state attorney general. If your state does not require insurance you may or may not be able to recover through small claims court. |

Well, obviously, no insurance company is going to pay you or on your behalf. One of you can try suing the other guy, but you may or may not get any money. |

Did you mean "insurance ON the other driver"? If you didn't have public liability coverage, your license will probably be suspended until you can prove that you do. If the accident was your fault and there was damage or injury to the other driver or their car, it will be suspended until you pony up what you caused. |
