I was in a car Accident friday, and the other driver was at Fault, How am I gonna get my car replaced?

I'm afraid you'll be stuck with whatever value the insurance company appraises it for, no matter how "mint" it is. You might be able to get a lawyer to sue for the difference, but it would probably end up costing you more than the car is really worth anyway.

#1) you are entitled to the fair market value of your vehicle if it is declared a total loss.
#2) you are NOT entitled to anything above that amount.
#3) there is the possibility that your vehicle is repairable and if so that is what the insurance company will pay for.
#4) a lawyer will be a complete waste of money (unless you simply WANT to give him/her/it 33% of the settlement). Despite popular belief insurance companies are not afraid of lawyers. Despite popular belief ( and despite what a lawyer will tell you) they cannot get you one dime over what a claim or car is worth. Insurance companies go to court thousands of times a year and have dozens of high paid lawyers on staff, so --- do you feel lucky?? Just remember, the lawyers ALWAYS get paid.....
PS -- if you really feel the other company is stiffing you then go through your own insurer -- (surely you have a policy in force to cover your antique/mint condition Benz -- right?)

Well, first off.. alot of people think there cars are worth alot more then they really are- so be realistic with your expectations. IM guessing by "antique" you really mean- old.

Now, her company only owes you actual cash value of your car. And that is what it is.. they just punch your VIN into a computer and it gives it to them. Actual cash value is what a car like yours would sell on the lot for (remember.. thats SELL for.. not what they are asking for it) So if you disagree be ready to back up your disagreement with evidence.

Be reasonable b/c if you just say "no i dont accept your offer" they will say.. fine.. go through your insurance.. they have no obligation to pay you.. your not their insured.

Do your research and be prepared to only get the value of your car in the marketplace.. not its value to you.

The only way you are going to get what you think the car is worth is if you have had it appraised and carry antique auto insurance, if you have regular insurance you will be lucky to get book value. You can sue the woman for the difference if you want to go that far.

Im sorry to tell you.. but u wouldnt get the money your looking to get or expect.. they look at the book value and they even lower the price down like crazy.. goodluck tho.. your car might be worth a lot.. but who knows.. goodluck.. Schooots
