I was exactly 9 weeks pregnant when some idiot pulled out in front of me and another car on icy roads. He thought he could make it across but I NAILED his back end of his truck. I was going about 45 mph after I slowed down but due to icy weather I skidded into him. My airbag deployed and my knees hit the dash. I chose not to go to the ER because I talked to the EMT and he said everything looked normal. I have an OBGYN apt. in a few days and plan on having everything checked then. How should I go about settling with his insurance company. Keep in mind I don't know how this will effect me or the baby long term, I am in so much pain and can only take tylonel. Also I feel as though my back is out of alignment. I can't do anything by myself. If they KNOW it was this guys fault how should I go about getting my car replaced and get money to pay for my hospital bills! Thanks Additional Details Okay I forgot to mention that the car I was driving was really only worth about 2 grand. BUT it was my way to school and to work. I had to miss 2 days ofwork and now I don't have any more days that I can miss without getting fired thanks to their no fault policy. So if something does go wrong I will lose my job. And I need to settle quickly so I can find a way to buy a "mom" car to drive back and forth to school.

It all depends on what state this accident took place in. The tort threshold requirements(compensation for pain & suffering)vary from state to state.
It sounds as if you are looking for compensation for an injury that you cannot document, at least at this time. No insurance company is going to offer you anything unless there is medical documentation that supports the injury and disability. It has been two days since your accident. You need to give it time. Your symptoms should resolve. Don't expect to receive compensation just because you were pregnant either. There is no medical evidence that your unborn fetus was injured.
Any way, nothing can happen until you contact the other party's insurance company and file a claim. They will complete an investigation, and let you know if they are accepting liability. Given the details you have provided, it certainly appears that you share in the liability. You were going 45 mph during an ice storm, and you struck the other party towards the back of his vehicle. You might not want to tell the adjuster that you NAILED his insured.
Regarding the medical bills, which you currently do not have any, if you have PIP coverage on your policy, your PIP will pay regardless of fault. If you do not, then the other party will reimburse you for these expenses less your percent of liability, if any. |

well if you are in so much pain, why didn't you go get checked out right then? if i was pregnant and was in an auto accident, nothing a paramedic could say to me would stop me from being seen ASAP. go to the doctor NOW. its normal to be sore for up to 2 weeks after an auto accident, it doesn't mean something is really wrong. his company should be paying to fix your car, for a rental while its out of commission, ALL your medical bills related to the accident, any lost wages from work due to the accident, and a small amt for pain and suffering. PLEASE go get checked out now and make sure your baby is ok! |

Let your conscience be your guide. Yes I'd take care the vehicle and any Doctor bills it may incurr and I would have a sonagram to see the baby yourself. It doesn't appear that their is any harm to the baby so do the right thing and take the high road. |

You should see a doctor, and get everything documented for
your records. Also do not settle yet with your insurance man.
See your family doctor now. Along with all your pain. You may
have internal bleeding, or damaged your spine. So get the
exrays and other tests. So what you have now, will make you
better, and ease the pain. And talk to a lawyer, before first.
If you sign off, and settle now. Like you said. You don't know
what is long term, or coming down the road.
With all the "schisters" out there. You have to remenber one
"rule" in life. "cover your @$$, because nowone else will."
If the other man was at fault, he should of gotten a ticket.
Your insurance should replace, or repair the car. Good luck.

you really should go to the ER, even if they can't do much, it needs to be documented that you went, and go see a lawyer. when I was in my accident, I didn't want to keep going to the doctor about my back, so when I settled, it was lower because they didn't think I was hurt badly. Now I have to pay to see the doctor about my back myself. Do not settle with an insurance company until you have talked to a lawyer. It doesn't cost anything to talk to them, and if they take on your case, they will take a portion of your settlement, but they won't charge you if you don't get anything. |

Talk to your insurance agent. They are there to fight for you. I would also keep all of the paperwork from your doctor appointments. Go see a chiropractor about your back as well. |
