I was in a car accident due to slippery conditions. My insurance was lapsed and I did not know.?

Now, I am being sued by the insurance company of the person that I hit. Am I going to go to jail?

No jail. It was an accident, nothing you did on purpose. They will sue you for repairs and labor for the car, lawyer and court costs and medical bills, if any. The state will also fine you for no insurance (they perceive lapsed as "none") but you can get out of that fine if you get your insurance reinstated. Do get a lawyer so he/she can help to get the amounts they sue for lowered. Good luck.

You won't go to jail, but you are going to have to pay out a LOT of money to resolve this.

You really need to be more responsible about things like that.

In the real world, ignorance will not save you, it will only worsen your situation.

No but you are going to owe some money maybe a couple of £K depending on the damage to his car aanad the extent of any personal injuries. Proper legal advice may save you some money. If you live in UK and have not changed your address recently I do not accept that you did not realise your insurance had run out. The insurance remind you a couple of weeks before and do not take the cash untill it is due and that takes about a week to get through to your card. You either delayed or had no intention of paying insurance

This is a civil suit and it rarely results in jail time.

It will be very expensive for you. You will have to pay for damages and injuries out of your pocket. Your license will be suspended. You will probably have to get an SR21 insurance which means high risk and high cost.

Not knowing that your insurance has lapsed is no defense. You will still pay through the nose.

Obviously, this is why people have insurance. What happens is that the other person's insurance company pays for the other person's damages and injuries under the provisions of uninsured motorist coverage, since you had no insurance. But their insurance company now will do everything possible to recover the money since it was your fault. They have lawyers and the full force of the law to recover the money from you in any way possible including garnishing your wages and forcing you to sell property you own.

No your not going to jail but your assets are at risk. If you have no assets, then you will wind up with a judgment against you for future assets. Included in there could be 100% of the court costs and plaintiffs attorney fees. the other thing you will deal with is the state reaction to "no insurance." There will be a fine. You could lose your license unless you get insurance. (no, they will not backdate to cover your claim) Good Luck.r

No, they don't put you in jail unless you committed a criminal act. DUI, reckless driving, manslaughter, that sort of thing. You are going to have to pay up, though.

I have a relative that works for an insurance company. She spoke to a customer who has had his wages garnished for the past 40 years due to causing an accident with no insurance. 40 years!

If it was your fault and not intentional or aggressive, they will probably just ruin you financially. You should get a lawyer, though.
