It is certainly possible for the other driver to have insurance that only covers his car. It is a lienholders policy that only covers the physical damage to the car while the loan is still being paid. I see it all the time. He let his own policy lapse and the lienholder bought a policy to cover their collateral only. The policy is probably through GD Van Wagenen. This policy does not provide any type of liability insurance.

If you have auto insurance you need to see if your policy has Uninsured Motorist Bodily Injury Coverage. You could use that to pay for your injury claim. You also need to see if you have Med Pay or PIP coverage to pay your bills.

In some states you can also have Uninsured Motorist Property Damage coverage that you could use to pay for the repairs to your car.

If you do not have any coverages on your own policy to help you then you will have to sue the other driver. But even if you win in court that is not a guarantee of payment.

it appears that you are also underinsured...you should have been carrying "UNINSURED MOTORIST" coverage.
you will need to pay your own bills...sorry.
if you would have had Uninsured Motorists Coverage...you would be sitting pretty.

I would call your insurance company first for any advice they can give you. You can take him to court, he would not go to jail, but it's not for sure you would see your money either. I hope your foot gets better, but if it doesn't, you really need to have it checked out and added to your claim. Good luck.

Do you not have insurance? If you do you should have a unisured motors policy.

If you did not file a police report at the time of the accident you are in a tough situation.

Did you get his info, by the way, if he has auto insurance of any kind then you are covered.

1. Punctuation, grammar and spelling. Check them before you post your question.

2. You *need* to go to the doctor to assess if you have an injury from the accident.

3. Find a personal injury attorney in the phone book and pay for an hour consult with them to see how they think you would do in a court of law. It doesn't hurt to call and find out how much an initial appointment is, but I think it would be around $100 for the first hour.

How can he have insurance that only covers himself? Or are you talking of his medical insurance, not car insurance? The minimum you can buy for driving is liability, which covers the other driver. What about your insurance? Or are you only carrying liability? You can sue, and get a judgement, but he won't go to jail, we have no debtor's prisons. If you foot is injured, and you don't have medical insurance, you still need to have it looked at. Go to a public hospital or clinic.

If he has insurance, it has to cover your vehicle, it's called liability insurance. I am not aware that anybody can buy insurance that protects only their vehicle. Why don't you have insurance? Your insurance would fix your car and then the insurance company would go after him.

If you don't have insurance, you get no sympathy from me. You got what you deserved.

There is no such thing as insurance that covers only the driver of his own car, is there?
What with the new no-fault deals out there, that is possible, but sounds utterly rediculous!
