I was in a car accident that was not my fault and the other driver is "self Insured" he was driving a rental. I called the rental company and they stated that he has what is called "NJ EXCHANGE" I called this company and what this means is that he has collateral such as "money in the bank" and he is not entitled to carry insurance. So if I put this through my insurance I have to pay a deductible and my rate will go up. Do I have other options? I called my insurance and they stated that I could sue him personally, and collect for the damages or put it through them and pay the deductible and they will sue him. Once they sue and recover the amount owed then I will receive my deductible back. Well I dont want this accident on my record since it was NOT my fault and he did not have insurance. I do have a police report and all proper papers. The thing is I am planning on moving out of state (1300 miles away) in about 2 months. I am so lost as what to do...Please all info and respectful thoughts appreciated...

Because you made the phone call to your insurance company, they've already noted on your records, so there's not much you can do as far as your record goes. Been there. Let the insurance company pursue it. Be prepared for your record to follow you to your new location, and whether it was your fault or not doesn't seem to matter anymore. |

If the accident is not your fault, the insurance rates will not change. The accident will not have any bearing on your driving record as you were not at fault. I was hit by a school bus, the accident was not my fault. My rates were not affected and my driving record was not tarnished. Go through your insurance, they have the lawyers, let them sue. |

If you were not-at-fault for the accident, your rate should not go up. Use your insurance, let them handle this quickly and save yourself the hassle. The good news is the guy has plenty of money, so collecting shouldn't be an issue. |

if he has "collateral" in the bank, he needs to get his collateral out and pay you. if a citation is issued it is all the proof you need. Your insurance does not need to sue him YOU do. Depending on the amount of the claim, you might be able to settle in small claims court which doesn't take more than 30-60 days generally, if you need to get a lawyer, and he is found to be at fault he'll have to pay those fees as well.

Ask him if he is willing to pay you directly, without being sued. If he has the money and neither of you wants to spend time on a lawsuit, it seems like the best approach. |
