How else do you think insurance companies make money?!?!? They over charge and then its nearly impossible to get everything out of them. They should pay out everything that your policy says they're liable for.
Watch out for clauses and "excess" charges. The idea behind excess charges is that the more exces you opt for, the cheaper your insurance will be because it means you are liable to pay whatever the excess is and they'll pay the rest.

If they're just acting irresponsible then go see a lawyer - the insurance will have to foot that bill too if they are found to be breaching their terms.

100% of what? Your payoff? Do you owe more than the car is worth? How about some additional information.

Your insurance never pays 100%. Only the cost of repairs (or actual cash value if totalled) less the deductible. If they collect from the other driver's insurance company, they'll refund your deductible.

Discuss it with your insurance agent and they'll explain it to you.

If you live in a no-fault state, you're out of luck. Your insurance pays for your repairs less the deductible and you CANNOT recover from the other driver unless there are severe injuries involved

call your insurance company and tell them. if you have a good insurance company they will pay for everything and sue the other drivers insurance for full compensation

Tell us more about what happened.

Not much. The police report doesn't lie. It only reports what
was told to them.

what state? most insurance company's only pay retail price not what you owe some do offer gap ins. that will pay off your loan

yoohoosusie
They have to, unless you have a deductible, which most policies do... If they do not, then you have to take it to court. What insurance do you have?

Sue the other person for damages. If it's a small amount, it may not be worth it, because you have to put out some money to file claims. But if a lot is still owed to you, then go for it. Just keep receipts from fixing car and any medical treatment you received.

It depends on whether you are talking to the other driver's insurance company or your own. Sorry to say it, but if you can't reason with the insurance company, you will have to get a lawyer to help you. Try getting your state's insurance dept. to help you before you do this. Hope this helps.

Sue the other drivers insurance company. Have your insureance company do it if they will if not get a good Lawyer.

Holla
You can file a claim with the person at fault's insurance company, but the thing with that is that person has to report to their company that it was their fault otherwise they may dispute it then your insurance may need to take them to court

Sue the person whose fault it was. And y wont the insurance company pay 100%. They definitely take 100% payments. U tell them that.

Tifferz
You can file a dispute with the insurance company, and lawyer up. It is unfortunate, but depending on the amount that insurance isn't going to pay, it may not even be worth the hassle...
