i've asked yahoo to list australian questions only so assume that is where you are from.

Of course, VEHICLE DAMAGE INSURANCE IS NOT COMPULSORY IN AUSTRALIA - so if you are in australia, disregard all the american answers.

if their insurer agrees that their own driver is at fault, then yes, their insurer will pay for your repair costs.

you will need to contact their insurer and ask them what their procedure is - you may have to get repair quotes yourself or they could simply send you somewhere to get your car fixed.

ps. YOU need to follow up with their insurer, their insurer usually won't chase you trying to offer you money.

You are getting a lot of answers from people who obviously are not claim adjusters.

The fact that you are uninsured, while not very bright, does mean that the other insurance company can automatically deny your claim. I have paid hundreds if not thousands of claims to people who didn't have insurance.

However, in some states like CA if you are uninsured you can't make a claim for "pain and suffering" if you were hurt.

BTW, the other parties liability insurance, not comprehensive coverage pays for your car damages.

And please go buy car insurance there are WAAAY too many uninsured drivers out there.

I believe they will fix the car. However, if you've suffered any bodily injuries that won't be covered.

Really depends on what state you are in. Here in Texas yes they would fix it, but your car would have been impounded so I figure your not here in Texas.
But yes the other persons insurance should cover your car and fix it as long as you got a police report showing that it wasn't your fault.
If you don't have a police report then you may have to take them to court.

There is no law, that I know of, that requires you to be insured in order to have your car fixed by anothers insurance. Just so you know, The others comprehensive is not the coverage that will pay here.

Depends if you in a no fault state or not. California, they are responsible to repair or offer settlement for your vehicle. Vehicle are not repaired under comprehensive, you need collision insurance or with the other parties insurance, property damage.

your car should not be there as it is uninsured his ins will fight it as you should not be on the road they could even sue you for the damage on the other car

you could take it to court and then you could sue the people that hit you. and fake an injury the doctors wont no and get a cast or somthing to show wen you in court i did that because i was parked a a store and a car hits my back and my head hit the steering wheel and i sueed for 14 k and i got it. it wont even hurt the purson it will hurt there insurence
