Depends on who the authorities believe. It also depends on what speeds you were both traveling at. From what you've said, it seems like it was the other guys fault but you must have been at the very edge of your lane to hit him if he was only a foot into your lane. |

if u ended up in HIS lane then it would be your fault. But, if he came into your lane then it would be his fault. But, maybe if the damage was a lot then maybe your colud split the expenses. |

These are tough ones. If there are no independent witnesses, the best way to determine fault is if a police officer (or anybody else) took photos at the scene. You would need to see in what lane the "debris field" is in.
You look for broken plastic, puddles of radiator fluid, windshield washer fluid etc. that makes up the "debris field".

Sounds like they will probably do a 50/50 or no fault. It comes down to your word against his/hers. You could have ended up upside down or dead. I am glad you are okay. |

If there are no witnesses, an adjuster would try to determine fault by the damages. Any disputes may end up with a comparable loss 50/50 |

Here's what will happen.
If you both claim it was the other guy's fault and neither of you have any independent witnesses to back up your claims, then it will be split 50/50. |

If you rearended him, it's your fault. If the front of your car hit the side or back of his car, it's your fault. If the front of his car hit the side or back of your car, it's his fault. |
