I was in an accident and he doesnt have insurance what should i do?

i was in a car accident where some guy hit me from behind on the freeway and it messed up the whole back of my expedition and now my back hurts. i went to the hospital in an ambulance and they didnt even xray my back when i told them it hurt they said i appear fine, is it possible that the hospital didnt do their job right and is there anything i could do about that? also i just found out he doesnt have insurance and some of the things on the police report look fake. i need my car fixed and my insurance doesnt cover it. what should i do?

I agree with Russ.. If you have your Uninsured Motorist coverage they usally will have a Deductable waiver so you will not have to pay out of pocket for your vehicle to be fixed.. And the Uninsured Motorist will coverage your injurys up to the limit you had specified on your policy...I really hope you got that coverage..

You can sue him, but I doubt you will recover anything. If he does not have insurance, he probably cannot afford to pay you for the damage to your vehicle. Should have kept your Collision Coverage.

You can file a Uninsured Motorist claim for you alleged injuries. If you feel you need further treatment, go to your doctor or back to the ER.

First you need insurance 2nd you need uninsured coverage..I assume also you have no health insurance?

You can go to the ER again if you like but it may not be guaranteed to be paid, back injuries usually are soft tissue and are soreness and spasms, your back is a touch bone to break with rear impact whiplash..If you don't have any resources pick and choose an attorney who specializes in personal injury..If the other guy has no resources contrary to television attorney representation may be just as hard to get..There is no big policy limit pot of gold waiting for them...

The only option you have without collision coverage is to sue him. Unfortunately, your insurance carrier can only work with the coverages you choose to have, no collision coverage means your vehicle is not going to be fixed unless you do it yourself.

As for your injuries, hopefully you have either Medical Payments or PIP on your policy, otherwise use your health insurance.

*** Note to all*** the way our economy is going there's going to be more and more uninsured motorists on the road. People are going to pay to have a roof over their head first than pay auto insurance. Make sure you have the right coverage to protect yourself.

If he has the money..then I would sue. Check your insurance and see if you have uninsured motorist. Also check and see if you have MED PAY on your insurance.

If you have collision coverage on your car, your insurance company must pay for the repairs after you pay the deductable.
The police report gives the name and address of the other driver. You can file suit against him to pay for damages and any medical treatment required. There are many lawyers who can do this for you, providing they think the other guy has any money at all. If he is broke with no job, they won't waste their time.
