I was involved in a car accident, in which I was rear ended, had no insurance, should I be held liable damages

Just purchased the car 11/22/2006, day before Thanksgiving, after 5:00pm, 11/24/2007 am, I was rear ended. My damages were on the right rear end, her dameges were on the front rear end. I was in the right lane. She stated in the police report that she tried to swerve into the other lane to avoid hitting me. She claims that I pulled out in front of her. Should the dealer be part responsible for letting the car leave the lot without insurance?
Additional Details
I was not given a ticket, nor the other driver. The officer did not issue one, because he could not make a determination on who was at fault.

if someone ran into the back of your car the accident is generally their fault as they are supposed to have their car under control at all times

haha wow.. it always cracks me up to see supposed "adults" try to hold others accountable for their actions.

Why on earth would the dealer be responsible for making sure YOU got insurance ? Do you NOT have a working brain? What did you think would happen if you got into an accident before you decided to insure the vehicle? I cant even imagine why youd think it was the dealers fault.

Now you have no one to defend you in this so have fun when the bills show up at your door from the other insurance company. You deserve it for putting everyone in danger.

Hi, My father was a traffic cop. I will try to find out more info for you within the next 24 hrs. I would think since you just purchased the car, it being a holiday they give you a grace period. I was obviously a private purchase. Nonetheless, Bottom line, She hit you, and her insurance company should pay for the damages. You were in the right lane. The accident reconstruction people will be able to see who's at fault. If the decision is not in your favor I would fight like hell. Bottom line again, she hit you and you were in the right lane. She is at fault. I will find out for sure tommorow and get back to you sometime in the afternoon. You mean her front end. Cheers

The dealer might have an issue for letting you leave without insurance, but it comes down to being your fault since you were the one responsible for getting the insurance and you failed to do so. Good luck with that.

i'd say argue it all the way if you were not given a ticket due to the officer not being able to determine who was at fault they aint got a leg to stand on as for the dealer i don't think they can be blamed i don't think they are required by law to request to see if you have insurance or not? but as for the other part it was her fault then argue it

I think the old stand by rule is if you're rear ended by someone else, it's their fault.

Can she collect damages? She might try or her insurance company may try to seek damages. You have just as much right to seek damages from her.

Usually, if there's a lien on the car, they won't let you drive the car off the lot without some sort of insurance. I'm not a lawyer but I think once you get off that lot, you bought it, it's yours.

I've heard of an accident like this before with a buddy of mine. The police couldn't determine who was at fault. As I recall, each person's insurance paid for the damages of their own car. But, as he only had liability, he didn't fix the damages to his truck.

I'm surprised you didn't get ticketed for not carrying insurance. Most states in the U.S. require at least liability insurance.

I knew a lady at work who had bought a car, much as you have and was stopped by the police. She said she hadn't had time to get insurance on her car. He said he couldn't let her drive it without insurance and had it towed.

Were you the one without the insurance or her, if it was you then it's your fault, don't leave it up to the dealer to get your insurance that's not his job, the responsibility is on you to get the insurance if you weren't sure then you shouldn't have been driving the car

In the state I live in [ Pennsylvania ] You are not permit ed to drive with out insurance, so it would not mater who was at fault, cause the driver with out insurance is automatically at fault because his/her car should not have been on the road uninsured. I do not know the laws in other states.

The car insurance is your responsibility. You can try to sue, but the whole point of insuring your car is to protect it in an accident. The accident may have been the other drivers fault, but without a ticket, you'll be hard pressed to get any money from the other person.

I take it that you are American. Why are you trying to put blame on the other driver. YOU WERE NOT INSURED, DUMMY!!!!! That's it. End of story. You lose, and quite rightly. It is because of idiots like you that insurance premiums are going up everywhere. You can be in a hundred car accidents, but if you ain't insured, it will always be your fault !!
GET INSURANCE BEFORE YOU DRIVE THE BL**DY CAR, NOT WAIT UNTIL YOU HAVE AN ACCIDENT AND THEN START WHINING!

she hit you, therefor she is held liable. take your car to get an estimate then get ahold of her since you have her contact info (right?). tell her she needs to pay or be taken to small claims court. also contact her insurance company and file a claim against them.
