I was involved in a minor car accident and now Im having problems with the other party...?

i was in a parking lot. i went to pull out and this lady zipped up behind me. we knicked bumpers. i apologized for the inconvenience and gave her my info. she was like 'oh no big deal' and that was that. a wk later she is calling me and harassing me saying i owe her money. i filed a claim with my insurance. a claim agent was supposed to get back to me within 24 hrs. its been 48 hrs now and i cannot get ahold of my agent or any agent in the claims dept in california. im gettin so irritated. now the ladys insurance co is calling me saying that its all my fault and i owe her. Isnt that harassment? Im so stressed. What do I do now?

First off, if everyone's okay, take a deep breath because this too shall pass. And for Heaven's sake don't go jumping to get an attorney - the only person that will benefit IS the attorney, with your money, for a minor accident like this.

There's not enough info regarding the accident to really tell you who's at fault. Ignore the comments about "parking lots being no fault", it's not true. However in most states the police won't write reports on private property, so people get confused and think that means no one's at fault. Liability is going to be based on the facts of the loss and your state's negligence laws.

Let your insurance company handle this, it's what you pay them for. Call the claims office again and ask for a manager if you can't get a warm body to pick up the phone the first time. Tell them you want to hold if they try to take a message. And hold until your ear falls off, eventually someone will take your call. Ask them to explain the law, your coverage, and the process to you in detail.

Nothing gets resolved in a day - the insurance companies will need to take statements from both parties, see the cars, possibly see the scene, so don't panic if everything can't get done today.

Deal with your company and tell the other person's carrier you'd rather they talk to your insurance company.

It'll all work out, hang in there and have a nice weekend.

Sorry, but, techically speaking, the accident was probably your fault. If someone is pulling out of a parking space, they're supposed to yield right-of-way to cars in the traffic lane.

Since your insurance company isn't being much help to you, next time her insurance company calls, give them your insurance information.

Do NOT communicate with the other party or their company in a combative situation. MAKE your company handle this situation -- check your insurance card or dec. page and see if there is a toll-free claims number you can call. Agents, for the most part, do not settle claims. To the idiots that want you to run to an lawyer -- this is useless. #1., they will not touch anything that does not involve injuries; #2., if they do, you will pay them DIRECT out of pocket for whatever they decide to charge you. Your company has an army of lawyers, so chill ---.

Since you have already filed a claim with your insurance, whenever she calls give them the insurance company phone number and tell them they will have to deal with your insurance, and hang up. Do not talk to her insurance company.

Sounds like you need a lawyer. Either that, or contact the manager of the insurance company and give him a shake up. That's not the service you're paying for.

Did you call the insurance agency as soon as it happened and explain what went on? Did you examine her bumper to see what type of damage was caused? EVERY time you are in an accident, whether you think there was negligible damage or not, you need to call the insurance agency, let them know what happened, and write down everything that happened, all the words exchanged, and detail the type of damage you saw on each vehicle. I had the same thing happen to me one day, and that's what the insurance company told me. Fortunately, though, neither of us wound up with damage to the vehicles, and the other lady never called me in. You may just have to document things better in the future.

No fault, in a parking lot each party will fix there own damage, you say it's not your fault, the other party states it's not their fault, it happend on private property (parkinglot) not city county or state roadway, don't worry about it,.. admit nothing,.. but don't worry

Neither insurance company will want to pay, thus leaving each of your with your own damages and deductibles to repair your own damaged vechicles.

There is no way the insuance company will be able to determine fault in a parking lot, no BIG --CSI-- investigation or anything

If your not injured don't seek a personal injury attorney,.. then you can get in trouble
