I was involved in car wreck hit a cow here in SC. Owners insurance company not paying me for losses what to do?

Cows owners insurance company admits guilt but is barely willing to pay even half of my losses. I cant afford a good lawyer and sure do need the money just to live. What can I do?

Im a hunting & fishing salesmen here in SC. Yes, they did pay to fix the car and it has been fixed. They also in writing stated they would pay all medical bills. My losses include over $4800.00 in lost wages in addtion to three sales presentations I was to sick/hurt to make Dollar General, WL Lee Flowers, HFW. They are medical bills over $ 2000.00 plus the need for followup care. My neck and back hurt after driving 100 miles are more. The offer of 5000,00 is hog wash. Im thinking of blasting SC Farm Bureau Insurance company back into the stone age. I also have a sworn statement from a witness that said the cow was out for over 48hours. I am hurting because of having to miss work for treatments.

What are your "losses"?
Could be you're asking for a bunch of cr@p you're not entitled too or would not be recoverable. Or you could just have an unrealistic expectation of what your claim is worth. It could be the insurance adjuster is being too strict. But just because you call it a "loss" does not mean I'm going to automatically assume that it's something reasonable and recoverable - that you are entitled to.
Since you provided little to no detail in your question....we can't really tell you anything.
Therefore, I suggest you follow up with your agent or an adjuster for your company.
The highest regulatory body in SC is the Insurance Department, you can follow up with them. They do have people that address customer complaints. Just do a google search and you can find their web page. |

Was a police report ever made of the accident? If it was, did the cow owner insurance company admit guilt in writing? If it is not in writing, they could deny making such a statement and it becomes "you said, they said". Does the police report indicate that you were not at fault? With proof, you can take them to court. Check the limit for Small Claims Court in SC. You can file the case in SCC. If you do not have proof of everything you have stated, then you have no case and have to suffer the loss. |

1 do you have comprehensive coverage on your vehicle?
#2 if you do have comprehensive coverage on your car, did you turn the claim into your insurance company? You would have to pay your deductible BUT if your insurance company thinks that someone else is at fault for the loss... they will try to subrogate or go after the party at fault for the loss. If your insurance company can go after the other person and they get any money back, you will be the first to get your deductible back.
IF you dont have comprehensive coverage you can take the other person to small claims court where you do not need a lawyer. |
