I was passenger in a car wreck where my driver was at fault, can i sue the driver's insurance?

I was passenger in a car wreck where my driver was at fault. So can i sue the driver's insurance? And can you tell me how that works? i'm from Philadelphia PA.Please get to me ASAP. Thanks

Were you injured? Do you have medical bills?

First you would need to make a claim with the insurance company. If you sustained a serious injury with large medical bills,the insurance company would pay you up to the bodily injury limit on the policy.

Secondly, you sue the person, not the insurance company. So in this case, it would be the driver of the vehicle. But even then, their insurance company would still handle the matter.

Regardless you would not get any more than what the limits are on the policy.

On a site note, if the accident happened in PA, then your bills would be covered under the drivers No Fault or PIP coverage. The insurance company will cover up to $5K in medical bills.

You would then make your "pain and suffering" claim under the bodily injury portion of the policy

Sue the driver for what? Unless you have physical injuries, you have no recourse but if you have legitimate injuries, yes, you can sue the driver. Is this a commercial driver, i.e. taxi driver/bus driver/chauffeur or a friend? If it's commercial, you sue the company that the driver works for, if it's a "friend", you sue him.

You do not sue the insurance company. They did not damage you. You sue the driver of the auto. That is the person at fault and caused your injuries. By contract, his/her insurance company is obligated to defend them under the policy conditions provided they have the coverage. They (the insurance company) should pay your medical bills up to the limits in the policy but once those limits are exhausted, or if they do not exist, they are off the hook leaving your driver responsible for the remainder of the bills.r

No you wouldn't sue the driver of your vehicle's insurance company, you would sue the driver. However did the person have permission to drive your vehicle? If they didn't then his policy will not respond. If he did then guess what? Under your policy anyone who drives the vehicle with permission is considered an insured person. So you can sue the driver, but because he had permission to use your vehicle he can turn around and tell your insurer, "Defend me." and your insurer is obligated to defend him and pay any judgment awarded against him. He is not obligated to report it to his insurer.

Were you injured and had medical bills? The driver's insurance company should pay for your expenses. If you know the name of the company, call them and put in a claim, if your friend won't.
