I was rear ended. I got 4 estimates. Offender will only pay the lowest and the shop is really low quality. ??

I got 4 estimates for the damage..$611, $608, $422, $319. She wanted to keep insurance out of it. The lowest $ body shop was request by the offender after seeing each of the other estimates. I am not confident in that body shop at all. I have advised her that I am willing to go to the $422 body shop, but she says that she will only pay $319. It feels unjust. All inconvenience is in my court, but she can tell me what she is willing to pay for it? Any ideas? Or laws that could help me? Thanks for the help.

You have the right to get the vehicle repaired where you want to, it is not up to her. Since she is not willing to compromise, let her know that you are going to file a claim against her insurance. If she will not give you her insurance info, then you can file a small claims action against her.

If you have collision coverage, go through your own policy. Your insurance company will seek recovery.

It is really not up to the offender as to where YOU want your car fixed. You are already doing her a favor by not getting the insurance involved. Make sure you get her address and send her a LETTER indicating that you are willing to go to the $422.00 and she will be responsible for the payment, or you will have no other alternative than to go report it or take her to court. The Court is in your favor if the accident was her fault

There are no laws that you can print out and show her and make her pay up.

The alternative is going through your insurance and turning her in, and letting your insurance collect, or suing her in small claims court. Don't forget to add in the rental car, for the 3 days or so you'll be without a car.

You're trying to do HER the favor. Tell her forget it, you'll just get it done at your dealer, and let your insurance company handle it. She'll straighten up pretty quick, and if she doesn't, she never intended to pay in the first place.

Tell her that her other option is to give you her insurance information and they will settle it. In retrospect, ALWAYS get the insurance information. Even if there is a verbal agreement to not use it you at least have a backup in case the liable party decides to back out of the deal.
If the person is not willing to give insurance information then I would definitely get the police involved.

Well if you are not accepting what she is willing to pay, then file the claim with her insurance company.

she messed up why do you have to pay for it. tell what you are going to do and that this is how much she needs to fork out. if not then did you file a police report do you have her insurance info. get it and take her to the cleaners for thinking she runs shi*

That seems really low for damage. Seems like you could sneeze for that amount of money. I would add your deductable that you have to pay and figure that into the cost when you go through your insurance agent. If you have to pay 1000 deductable, then the 319 sounds good.
