I was rear ended but Geico don't wanna pay help!?

I was rear ended by a Geico driver and they car had a total of $587.00 in damage. I went to the Emergency room and also a Chiroprator I was having Neck and upper back pain. The Chiro took X-rays and my neck bone has moved outta it's normal place. Geico is telling me there not paying for the Chiro bill or missed wages because I didn't need to go to the Chiro. But they will pay the Emergency room bill. And since they are not paying the Chiro they are gonna give him 50% of my Emergency room Bill. Is it right for them to tell me how my body feel?? Is this Legal?? What can I do from here?? Thanks everyone.

With the impact being very minor (Just over $500 in dmgs) I can understand how they do not feel that the accident caused your neck bone to be "moved outta its normal place" as you put it.

If this was the case the ER would have noticed this when they exmained you and obtained xrays.

If you have health insurance, or medical payments on your own auto policy, make the claim with your insurance carrier and let them attempt to collect the money back.

If you retain a lawyer to handle the claim for you, that still does not mean Geico will pay you.

contact YOUR insurance company and open a med pay claim. they will help pay your med bills and if the other party was at fault, they will subrogate back to Geico for reimbursment. let your company fight it out with the lizard people, thats what you pay them for.

I agree that you need to get your company involved. I don't know that it is necessary to SUE SUE SUE like some are saying. That isn't the answer for all problems. Have your company contact them and hopefully they will step up and do what is right to settle your claim. If they don't, your insurance can make recommendations on what further action is necessary. Ok...well...here's the thing......

A chiro....is not a doctor.

I know people act like they are...but they aren't and that's where people get into this kind of issue.

Only a DOCTOR can authorize you to take off of work.

If you took off of work because you didn't FEEL well...then - the short and simple of it is - that's on you. You would need a REAL doctor's authorization relating your injury to the accident in order for the insurance company to even CONSIDER your time off of work.

Ouch, right?

And - if you went to the ER and the ER said there was essentially nothing wrong? Well...THEY are the Dr's and would logically know better than a chiro.

AND....do your research.......Almost EVERYONE's neck is out of alignment. Really. It's no big deal 99.7% of the time. Just because the chiro took xrays that show your neck is out of alignment does not mean the accident caused it.

AND, as a former auto adjuster, if you had less than $600 worth of damage.......the insurance company would be able to prove, by means of a biomechanical expert, that it is impossible for that impact to have caused your neck to be out of alignment by the force of the impact.

Sooooo...hopefully you're getting the picture here.

What can you do? You REALLY might be between a rock and a hard place.

Can an attorney help you? Sorry - attorneys can NOT change the FACTS.

You MIGHT be able to get them to settle with you as a nuisance but...........in this kind of situation...you are much more likely to get yourself into a lot of sticky red tape. It SOOOOO looks like fraud when someone in a low impact accident pushes an injury.

(I've handled claims with minor vehicle damage where the people treated up to $15,000. The claim went to court and the JURY awarded those people...........ZERO dollars. NOT a situation you want to be in.)

I guess there's not a whole lot of good news in this answer but....this is my experience as an adjuster. Auto is my specialty.

SUE, SUE, SUE. If you're telling the truth and you have a legitimate claim, a lawyer will represent you. If not, they won't. By the way, my wife is a claims adjuster and she won't pay out on chiropractors either. She thinks they're quacks and I have to agree. Go to a legitimate MD, an orthopod, and see what they say.

Geico strikes again. Funny how Geico keeps changing it's rules. I used to be a Geico client and I found out that the only 2 times that they find someone completely not at fault is a) if the car they insure was parked legally or b) if the car they insure was struck in the rear.

If what you're saying is true, SUE, hire an attorney and sue. Sue Geico & the other driver. Keep all of your accident paerwork together in a folder and present all of it to the attorney.

Are you kidding me? do you know how MINOR 500 bucks of car damage is?

How on earth were you "so hurt!" that your "neck moved out of place." do you really just expect the at fault party to pay ANY injury the other party claims? do you know how ridiculous that is? Do you realize how much YOUR getting taken advantage of right now by a lousy greedy chiro if your not the one money hungry here?

Youve got to be kidding me- you either have a doctor who wanted money so made up lies about this being accident related (you probably had this condition before if its real)or you were eager for the big bucks and now realize you wont get them.

Your not an eggshell, your a human. 500 bucks are car damage DOES NOT cause that much bodily harm- thats ridiculous. I bet if you posted pictures of the damage on here.. people that think im being rude right now would have their eyes opened to how little damage that is and how silly your being.

Seriously people need to get real.

i was in a car that got rearended at 45 mph it crushed a disc a 2 bulging disc. The geico claims adjuster said there was only 600.00 dollars of damages to the car ,but he never had the bumper removed . . So your theory on there could be hardly any damages to someone with small amount of damage to a car is false. therefore your conclusion that someone being seriously hurt with a small amount of damage to a car is false. also my wife was in the car as well and has serious damage to her back. Its been 18 months after my surgery and im still in constant pain. I got paid 100k but my wife hasnt settled yet .By the way I was in very good condition my occupation as a commercial diver kept me in great health.
