On Feb 16 2009 I was driving my 2009 Acura. I was rear-ended while stopped on 294 North by a 1997 Toyota. The IL State Police officer's report supports this. The other driver was issued a ticket for "failure to reduce speed" and "following too closely". The other driver's insurance company claimed that their client said I "stopped suddenly and locked my brakes" and thus they will pay no more than 70%. My car currently has an estimate for $10100 and work has not started yet. No lawyer will touch it on contingency because it is property damage only and I am not claiming injuries. How do I get this resolved quickly. And no, going to my insurance is not an option. I was driving a company car and they aren't very helpful because it is a fleet policy and there is no personal relationship.

So what if your employer says essentially "file a claim with our insurer and you're off the company car program" ... I did not ask to be rear ended nor did I invite it. But the "have your fleet insurer" handle it responses are helpful, but don't help in this situation. Basically, sounds like I just am getting screwed thanks to a crappy insurance company on the part of the party that hit me.

It's clearly the responsibility of your fleet insurer to sort this out on your behalf, otherwise why would you even have insurance. |

You say you were driving a company car, so apparently the company owns it. If that's the case, and it's not YOUR car, the settlement is up to the company; you have no say in it. You shouldn't be involved in the case at all except as a witness. |

You don't need to have a personal relationship with the fleet carrier to click them in. You aren't the one who should be dealing with this, the carrier should be handling it. |
