I was minding my own business and was rear ended. When the two of us pulled off the road, the guy said he got hit from behind but the guy drove off. I did not witness this. I didn't call the cops (stupid, i know. hindsight is 20/20).
Now his insurance company is saying they aren't liable because it was the 3rd vehicles fault. They said my insurance should cover it under the uninsured motorists clause.
I think this is total bs. 1-why should I pay a deductible when I didn't do anything wrong, 2-he hit me, he is insured, he can pay for following to closely or something. Let his insurance company pay for his damages under that clause.
Also, this happened on a wednesday at 3:30. I received a letter from his insurance company informing me they wouldn't be paying the following monday night. The envelope was postmarked for the friday after the accident. I don't even think my insurance company has checked out his vehicle yet. Waiting for a call back.3.
Basically I feel like I am getting screwed and I did nothing wrong. I am planning on fighting with his insurance about this, just looking for some tips on how to go about it.

I talked to my insurance company again. They told me someone was sent to appraise his vehicle, and that there is no fresh damage on the rear of his vehicle. They will be pursuing his insurance company further.
And I realize that accidents happen. I posted this question because obviously I feel like this case is different, not because I'm in need of money like someone wants to insinuate. Its the principle. Thanks to everyone else for their input.

Set up a claim through your own insurance company. They will then subrogate against the other driver's insurance. In the meantime though, you will be responsible for your deductible. Your insurance company will hopefully be able to recoup this for you. |

Now, the insurance company has no legal record of the accident, so its pretty much his word against yours. You probably won't get covered on this. You really should have called the cops. |

His company and Sarah K are right; you probably won't get anything from the second driver's company because he was an innocent victim, too. Be thankful that you have the uninsured or collision coverage, and bite the bullet on the deductible. Without the third driver's info, you're stuck. |

Insurance companies almost always try to avoid paying. That's why they have so much money. Good luck but I doubt you will get any satisfaction. |

Im confused. Hes an innocent victim too. He was rearended himself and pushed into you... so why on earth should he have to pay?
Im assuming he probably has damages on the rear of his car to confirm his story. Just b/c you got screwed here doesnt mean you should try to point fingers at anyone to try to get money.
Many times when you are not at fault in an accident you must pay. Theft, Fires, hit and runs.. thats life. |
