You would have to look into your policy. But most likely, you replacement will be the value of the car. call your insurance company. They know the details of your specific policy. |

They are responsible to provide you with a rental car until you get a new one. Call their insurance company right now and tell them which agency you are getting a car from, and they will cover it. Call your insurance agency and inform them, but you won't need to use your gap insurance. Keep hounding Verizon's insurance company until you get everything you need. Your insurance company will do the fighting for you if you want. That's why you pay premiums. |

Im sorry to hear about this....sometimes your insurance pays for it or the other persons insurance. When your car is totalled they have to pay for the whole amount of the car. My friend got in a car accident but she didnt have what you had which is the Gap insurance so they payed only the car value of the car and she still will owe some money to the bank she finance. But her insurance didnt pay for a rental or anything because it was her fault. I hope this helps. |

Hopefully you are not SOL. Unfortunately, you are dealing with a corporation, which tends to move slower than a personal auto carrier. These corporations are for the most part self insured (carry large SIRs) so you will be dealing with their TPA (claims administrator). Find out who that is. Contact them, find out who your adjuster is. Remember this adage. You can get more flies with honey than you can with vinegar. Sounds like you think your car is totaled? I wouldn't doubt it. The adjuster will send an appraiser to see your car to get an ACV (value). In the meantime you need to do your homework. Go to kbb.com and determine the value. Then go to autotrader.com and see how much similar cars are selling for on the market today. That is what they owe you. The market value. So you shouldn't be screwed if you can go out with the money they pay you and buy the same thing. Gap ins might come in to play and yes it was smart. The tort feasor (verizon) owes you a rental from the time your car became undrivable until the time they make an offer to you. Try to get them to direct bill it. Are you sore at all? That is considered an injury and is compensable. Good luck |

Since the Verizon truck said he was at fault, verizon should be providing you with a car untill your other one is fixed. It doesnt hurt to have a sore back either. |

First of all, if they are at fault, then they should be providing you with a rental car NOW so that you don't have any transportation issues. Call their insurance company to make the arrangement, it should be fairly simple, and they will pay for it all, no up front cost for you.
Second, the value of the car and the value to replace it are the same thing. |

Verizon would be liable for the LESSER of the cost to repair, or actual cash value at the time of the accident. They do NOT pay to replace the car.
And, if it was within a few months of being paid for, then the gap business won't apply, as you weren't "upside down" on it. |

Contact your insurance agent - he can answer your questions. Also, you should be able to get a rental car and Verizon should pay for it until you get another car. |

So many useless answers.
Depending on how quickly the company's insurance gets a check into your hands, you may be best suited to file a claim against YOUR insurance just to get the ball rolling. If the other party is determined to be at fault then the insurance company will subrogate the other insurance carrier to get the money from them (and refund your deductible if you have to pay it up front). When you are rear-ended the fault is almost always on the person who hit you so it sounds like this should be pretty cut and dry. Also, insurance would only pay what the car is worth. Gap insurance really doesn't help you because that only comes into effect when you owe the bank more than the car is worth. |
