Your insurer and their lawyers should sort the whole thing out if you wish to make a claim for personal injury. Someone who has approached you will no doubt be a so-called 'ambulance chaser' who may extract a large chunk of your settlement for his fees. I think it is unlikely you will receive a serious amount of money unless you can proce loss of earnings as a result of the injury (obviously not gonna be anything there in re your kids) so you will only get a small conpensation for discomfort/ distress, the levels of which have been massively reduced as regards damages in the last few years. |

The attorney isn't some humanitarian, he will get 30-40% of whatever settlement you receive. If you aren't seriously hurt, don't sue. This is one reason insurance is so expensive for everybody. |

The same thing happened to me but thankfully I was the only one in the car. I went to my solicitor who handled the case and I got compensation. You are entitled to compensation, but just make sure you have a good lawyer and not someone who has just called you up over the phone. |

If you're not injured, do not file a personal injury compensation claim. The attorney is just trying to make money. Insurance rates go up when people claim they're injured when they are not. |

you can claim for you all. i think u shud as car crashes can be painful and can affect everyone involved if the driver who caused it wasnt driving properly he shud be punished.

yes i have. twice. you have to go see a specialist who will assess your injuries and he will send a report to your solicitor. it takes a long time, and you will not receive a great deatl. i waited 18 months and got £400. good luck. your insurance co will sort it out for you and give you the name and address of the specialst. discuss it with them. |

in a word. claim. i suffered a whiplash injury over 6 years ago, and still have occasional neck probs. if the lawyers are anyway half up to the mark, they will do all the work. |

I was hit in a rear ender the car was a right off as I wasa hitting the brake I was braced holding the wheel so luckily did not suffer injury BUT my wife (pasenger) Suffered whiplash she had to go to a doctor that his ins said and she claimed for injury and received £1000 if you went to hospital soon after the accident it carries more wieght for compo

First of all I would check to see if you have legal expenses insurance (uninsured loss recovery insurance) in place - either under your policy or sold separately by the insurer/ broker. If you have then don't touch the lawyer with a barge pole.
If you do want to go that route make sure that the lawyer/ firm have registered with the FSA for the purposes of administering these types of actions an dmake sure you understand what fees/ deductions from any setlement would be made.
With regards to your injuries, you normally have three years to make a claim against the negligent person. Your children have until the age of 21 (3 years after reaching their majority) to make a claim. Although they cannot sue directly, they can do so through their next friend i.e. you.
Quantifying the claim may take a while as you have to be certain what injuries you and your children have suffered.Once a settlement is made it cannot be re-negotiated if subsequant injuries turn up. |

This happened to me. The injury lawyer was contacted by the insurance co. Make sure you go to your GP and to the casualty dept of your local hospital for x-rays to make sure there is no lasting damage to you and the children and to get evidence. The lawyers will send you to a specialist Dr. Make sure you claim for everything that you have had to pay out inc. child minders while you went to the doctor etc.It may take some time but I got £2000 which included loss of earnings, which was my main priority as I got in dept while off sick. |
