If a car has been scrapped, can it legally still be driven?

We scrapped our Nissan Micra a few months ago and recently people had been telling us they had seen the car being driven around the city. We followed this up and sure enough, we have seen our car parked on roadsides and being driven a few times. The tax disk on the car is in date and the number plates are the same. Is it legal for someone to be driving the car when it was officially declared as scrapped. (We have the documents), or legal to insure?

It depends on what state you are in.

Usually "scrapped" means, you sold it to a junk yard. It may or may not have a salvage title on it, but you SHOULD have notified the DMV that you no longer own the car. If you haven't done that yet, do it now - go down and fill out the transfer of ownership form.

Yes, if an insurance company isn't told there's a salvage title, they won't know. Yes, it's legal for the junk yard to sell it to someone else, after you sell it to them.

No, not in the State of NY. ONLY if the vehicle is deemed "SALVAGE". This happens when a car has been stolen, in a flood, or in a accident causing 75% cost of the value to repair. A salvage certificate 907A is then issued. The vehicle can be reused but only after te vehicle goes through a Salvage Examination. If the vehicle is brought by the owner himself or tow truck with granted authority to a scrap/ recycle facility also known as a dismantler (parts sold as parts then the rest is recycled) the title of the vehicle must be given up by the OWNER or representative (usually the donate your car programs) brings who brings that car in to be recycled, and then is turned into a Certificate of Recycling/ Dismantling 907M. Once the 907M is issued to a vin on a car, that car and VIN can never be used as a "vehicle bearing that same vin #" and thus never TITLED or REGISTERED as that VIN again.

However all of the parts may be used in any other "rebuilt" or repaired vehicles (differnet vin). This is the in accordence to the NYS DMV rules and regulations.

This happened to me. All I can think is that the insurance company (who presumably declared it as scrap, beyond repair) sold it for its scrap value and someone has taken the time and effort to repair it. The other, not so good possibility, is that ii is a 'cut and shut', in other words part that was not damaged has been welded to part of another car similarly written off. This is very dangerous. However, you say the tax disc is in date. The new owner could not have taxed it without current insurance and MOT

aaaaahhhhhhhhh i didnt want to bring this up but whats the diff//its not yours/the guy owns it and thats all his business/if it makes you feel anybetter maybe he had one that was wrecked but most of the stuff he could change over/sounds good to me
