My neighbour insists on parking his motorcycle in between parked cars that are parked along the street outside (ie not in marked bays), almost always this results in there being a tiny gap to manoeuvre the car to be able to get out of the space. If I accidentally hit him, is it his fault for not leaving enough space, or mine for hitting him, even though I would be blocked in? BTW we have mentioned it to him before but he still does not leave much room for the car to get out. Additional Details Right so he blocks me in I am supposed to wait for him to move it then?

If you hit a stationary object, it doesn't matter what the object is, it is your fault. I can't believe you think it is worth asking the question, the answer is so obvious. |

If you hit, and damage someones property, the question of them not being legally parked is moot, it is your fault, and your insurance will pay for any repairs. |

I think the general rule is that a moving vehicle is at fault first, a stationary one second, if at all.
However, you could report him to the gendarmerie as he may be causing an obstruction, which might be an offence. |

The next time he parks in front of you, call the police, tell them the situation, and see if they will have the bike towed, as it is obstructing traffic, and illegally parked. If they do, then maybe he will get the idea. |

Ok, so he blocked you in, but you knew who he is and where he lives.
Did you ask him to move the bike before trying to move your car?
If not, its wholly your fault. |

I would try not to park so close to the car either behind me or the one in front of me, this way you give him very little room and you have a maneuverable way out. Without seeing the situation and the amount of room I can't really give you a better solution. Yes, it would be your fault if you accidentally "tapped" the bike. Have you contacted the police about this guy and the way he parks? Sometimes (and I mean sometimes) law enforcement officers can clear up a situation, since talking to this guy isn't working. If ever you tap his bike (trying to maneuver your car out of your space) then I'd go for the gold and push the accelerator to the floor until your car is on top of the bike! When he begins freaking out then I'd let him know that you were nice about this situation until now!!! Only do this if you know your automobile insurance is in effect! Sometimes aggressiveness can clear things as well! Good Luck! |

Your driving into a stationary vehicle - your at fault.
To stop his inconsiderate behaviour -make sure you flatten his bike completely, ie run it over and then accidental reverse over it again and again (about 40 times should suffice), whilst trying to understand why you though your exhaust was being a bit noisy. Well worth the no-claims bonus going up in smoke.... |
