If a rock from a truck hits my windshield and breaks it, can i file a claim against the truck insurance compan

Since there are two different ways that a rock can hit your windshield I'll answer from both perspectives.

1. If the rock is kicked up from the roadway by the tire of the truck you have little or no chance of collecting. In order for the truck to owe you for the windshield they have to be negligent in some manner. If the truck drives over the normal size (quarter size) rock and it hits your windshield that is not negligence. If the truck runs over a basketball sized rock then that SHOULD be considered as negligence.

2. If the rock comes from the box of the truck then your have a better chance, although not guaranteed, of collecting. If the truck is carrying a load of rock and it is not secured in the box of the truck and some rocks come out then that should be considered negligence.

Either way is a tough claim to make. If you have comprehensive coverage on your policy consider using that coverage. Then you company can try to collect back your deductible from the trucks insurance company.

---well i dont think you can file a claim unless there is proof that it happend and the truck doesn't have the 'tire blockers'(those rubber things) -- but if you really can then there would be a lot of claimes due to rocks and gravel being everywhere on the roads
--- BUT your insurance co. may offer a plan that if by chance the window does break because of the rock you pay a very low deductable and they will fix it for you

Unfortunately no not with the trucks insurance company. They will claim that you can not prove the rock came from the truck, and the truck had mud flaps etc etc. It's quite a hassel and not worth the time. The same thing happened to me a while back and I ended up filing the claim with my insurance company.

Do you have a witness besides yourself who saw the rock fly off the truck and hit your car? Do you have a police report that says the truck company was at fault?

If not.. your outta luck. Without proof.. they arent paying anything.

Sure. But unless the truck was not properly maintained and was missing the "mud flap" on the tires you would not collect. If the truck is properly maintained and equipped and you caught a rock, you were following way too close, and it's your fault.

I think it depends on the company. I have seen trucks with signs on the back saying to keep back because the company will not pay for windshield damage from debris off their trucks, which I think is a crock. I've had those kinds of trucks cut in front of me and throw debris, so how is it my fault if I'm not back far enough to avoid debris.

Anyway, if you would file a claim, make sure you have the truck's license plate number or operator number if it's listed on the back of the truck, and also be able to tell them exactly where the incident occurred. Witnesses would also be helpful, if possible.
