I was driving behind a huge blade snow plow type of thing. He pulled into the middle of the intersection and stopped, and I stayed stopped behind the white line at the light. I could see the back of his head from where I was sitting, in my little nissan sentra, so he should have been able to see my car if he would have looked. Anyways, he just starts backing up in the lane and comes at my car. I honked and tried to reverse but I was kind of scared and in shock since I've never been in an accident or anything and didn't move fast enough to avoid the collision. He didn't even know he had hit me until his thing "stalled out." He was ticketed at the scene for improper lookout, but now he is going to try to fight it. Do you think he will win?

Your car was still at a line, so it was his fault. He can try to fight it because if you or the cop does not show up in court he wins. Which is why so many people go to court in the first place. That and reduced fines. |

It's mostly his fault. You probably could have prevented it had you kept your cool and moved. But, by law, since his vehicle was the one in motion, he is the cause of the accident. |

NO!!!!!! It was his fault and the cops seen it that way.That's the reason they gave him the ticket in the first place. |

Fault is at blame with him. The only reason he is fighting it is probably to do with keeping his job, I don't think he will personally win.

You were a good distance away from him so it was his fault not to turn his head and look at you. You shouldn't be too worried. If I were you I'd find a good collision lawyer and sue the hell out of that guy. Not only because you actually got hurt ( physically / psychologically ) but also the fact that he's trying to lye to the law reinforcement for that he's not liable for the collision.
Look up at the yellow page & find a collision lawyer. It will give you a few extra $$ |

Anyone going in reverse during an accident is automatically at fault, report this to your insurance and let them sue the guy. |
