two different kinds of liability here:
Criminal liability: The owner may face a penalty if the allowed an unlicensed driver to drive the car. And the unlicenced driver faces a penalty as well. This is a fine paid to the state (typically).
Civil liability: In most instances, this comes down to what happened and who caused the accident (i.e. fault). But that is typically on the drivers, not the owners. |

depends on state laws but usually the insurance policy for the car of the person more at fault is the one that pays (liable)...be prepared for your insurance company to drop you after letting an unlicensed driver drive your car. Stupid thing to do. |

He is but you'll get charged for allowing him to drive.
Then he'll go to jail for driving uninsured.
Imagine if he hits a Rolls Royce driving your car and your insurance won't cover it.
Or even worse he cripples a kid and 3rd party won't cover it.
You'll both be stuffed for life paying every cent you earn to the kid.
If you are really that stupid, you deserve what you get anyway, I just feel sorry for the poor kid you hit. |

The owner of the car.
The insurance will not cover an unlicensed driver. So the owner will likely be responsible to pay all damages.
You can't even take the driver to small claims court and win, because you are the one responsible for letting them drive the car.
Looks like some people have to learn their lessons the hard way. |
