I agree it was my fault but i'm trying to see if the person will pay half of the damage because he was illegally parked.

No fault insurance and 2 wrongs don't make a right.Why would someone pay half the damage for your negligence?Parking or driving legal/illegal you just don't hit cars without being fully responsible.You caused it to happen by your driving,they didn't by theirs. |

It doesn't matter where the other car was parked. You hit a stationary object and are 100% at fault. If you asked me to pay half, I'd tell you to go pound sand. You should watch what you're doing. |

its YOUR fault 100%. Two different problems and proceedings. The police should fine that person for being illegally parked, HOWEVER since it was stationary, it was your fault for the wreck. |

It makes Absolutely no difference that the other vehicle was parked illegally. Damages caused by your improper backing are your responsibility. Even if the other party gets a ticket for illegal parking, it does not and will not relieve you of liability as far as insurance is concerned . |
