There is no "but he should not have been on the road for me to hit because his drivers license is suspended" defense.
In the end....if your negligence caused the accident....then you are at fault. |

It doesn't matter if they're suspended, underage, aliens, or anything else.

The other driver having a suspended license has no bearing on the accident. If you caused the accident, you are at fault. He will get a citation for driving on a suspended license, but you will have to be responsible for the accident. |
