The person who hit him will probably be at fault, unless it's his fault that he got hit, like pulling out in front of someone or something, BUT he will probably be barred from receiving a license until he's 21, and will pay HUGE fines and be put through juvenile court, etc, because he still was wrong. |

It depends on your insurance company and the adjuster. They will do a liability determination. If they determine that the other party was negligent to control his vehicle then the other party will be at fault. But there is also a down side. You son does not have a license and does not have experience to drive. If you son had not been on the road the accident would not have occured. Your son could be held responsible. Either way your son will be held liable for something and you'll be paying for it |

Obviously, the cops are going to gather the drivers' info as soon as they show up on site. Seeing that your 16 year old son is driving without a license, he is probably going to be pegged as the cause of the problem. (Was he violating a traffic law and that was the direct cause of the accident?)
Whose vehicle is he driving? That's the next question the cops will ask. That person will be the responsible party... in so many ways. Insurance companies will deny claims that were created as a result of breaking the law. Driving without a license is illegal. All property damage will have to be paid out of pocket by the owner of the car.
If your son was using a neighbor's car, I bet you could expect a summons to court if you don't do the right thing and pay for the damage up front. If your son is not working, he better get a job and fast!! |

He was driving without a licence, then your insurance wont cover your car. Might be the other persons fault, like if they rearended him... but they dont have to pay it all, both are wrong cause he didnt belong on the road at all. |

What really matters in this loss is what was the proximate cause of the loss. You don't say what happened in the loss. So I can't really say who's at fault. Fault is not determined by who did the hitting or even the police report. Fault is ascertained by the adjuster investigating t he loss. They will do a full investigation to include statements from both drivers, obtaining the police report, looking at the damages, witnesses, and then they will make their liability decision. It is important to know not all losses are 100% one person's fault so comparative negligence may apply. this basically means that while the loss is 90% one person's fault you may have contributed to the loss 10%.
The fact that you son does not have a license is not an automatic at fault. just like not having insurance is an automatic at fault. this just isn't the case.
What will happen is that your son will probably not be able to get his license till he's 18. Your insurance company may raise the rates or at the very least exclude him from the policy. He will not go to jail.

why are you letting him drive without a license?? Now they're going to blame it all on you and charge you for all damages, and your insurance will skyrocket. Insurance wont cover any of these damages since your son/daughter was driving when they were not supposed to.
On top of that, your son cant get a license until 21 because he was caught driving without one. |

The fault for the accident is of whoever does the hitting, whether the person has a license or not. Whoever is at fault for the accident (his or her insurance company hopefully) will be responsible for the damages incurred.
If it is extremely clear who hit who, then the worst that will happen to your son is a citation for driving without a license.
If the accident is not so clear to decide, the other person will try to argue that the fact your son does not have a license caused him to hit your son.
That argument is complete bogus and you should fight it (if that is the case).
For example: if a 16 year old who just got his license this morning got hit, and the person who hit him tried to say that the young man's inexperience was the cause, would it work? NO! Your son is as experienced at driving as any other 16 year old, licensed or not.
If your son did not cause the accident, keep telling the other person that it is his fault, he needs to pay and expect for him to get a ticket; it happens...
