If it was the other drivers fault and they have insurance, they have to pay. Your only other recourse is small claims court, if it is a small claim, good luck! |

Contact your insurance company. I have Allstate and if it is the other driver's fault & their company won't pay...they go after them for the money. Or at least that is what I was told by Allstate when I was hit by another driver. |

Insurance companies are obligated to pay claims for which their insured's are responsible for.
So - if they're not paying it's either that 1 - there is no obligation (cause the insurance cancelled or something) or 2 - that the person is not responsible.
What do you do? Depends on which of the 2 above is the reason they are not paying.
Best bet - report to your insurance company and have them sort of the details.

There are TONS of reasons the other company may not be able to pay .. and 99% of them a lawyer cant do crap for.
For example-
1. was the policy expired? Thats not the companys fault... they wont pay for that..
2. was an excluded driver driving or someone not on the policy? This could lead to denial of the claim
3. Was it word vs word and they are siding with their insured? unless you have SOLID PROOF they were at fault.. they are going to budge.
How are we supposed to help when you dont tell us what they are denying your claim for? |

Depending on your coverage, your insurance company would cover your damages minus your deductible.
Was fault determined? Or is the other insurance company just being intransigent? If you were at fault, you're out of luck. If the other party was at fault (as determined by police report, etc.), then your insurance company should go after them. |

You file with your insurance. If it is the fault of the other driver, your insurance company fixes your car, you pay the deductible, your insurance company subrogates, and, if they collect, they pay back your deductible. If it is your fault, you file with your insurance company, and don't get your deductible back. |

get on the phone with your insurance an tell them to get on to the other parties insurance an get it sorted or you will take your costom else where. no luck then go to citizens advice bureau an see were you stand legally an find out what you can do |

Easiest thing to do is go to the local court house and file a small claims lawsuit for the maximum amount. Then have 3 estimates. You will win in court. |

I was in an accident 2 nights ago where a girl ran the red flashing light and I hit her. There were 3 witnesses confirming that she ran the red light and she also left the scene on foot. She did return and was taken to jail for driving under the influence. The car she was driving was a rental car that was registered to a friend of hers. I did not have insurance at the time but my car is undriveable. Is the retal car company still liable to pay for my damages even though I was not insured at the time? |
