You own the car, so all you need to do is go to the impound yard with proof of ownership, proof of insurance (just in case they ask to see it) & pay the towing/impound fees. Then your vehicle will be released to you.

Even though your gf has a suspended d/l, if the other car was at fault, the rental agency or the renters personal insurance will pay for any damages to your vehicle.

Now here is one thing I've seen happen & can possible apply in your case- the insurance may come to an agreement that your gf is to burden a % of the fault for the collision by driving illegally & the settlement from the rental agency or the other person's will pay you towards the total cost of the repairs of your vehicle minus the % at which they put on your gf.

Example: Let's say that your vehicle sustained $1000 damage & the insurance determines that your gf was 25% at fault for driving illegally. The insurance will pay for 75% of the repairs & the remaining 25% will need to be paid out of your own pocket.

Just let your insurance handle the rental agency- that's what you pay them for each month.

First you should have reported the accident to your insurance company. Your insurance and the rental car's insurance will handle all the damages involved in the accident. You may retrieve your vehicle from the impound lot by showing ownership of the car, proof of insurance and pay for the towing and storage of your car. Good luck!

In UK She is not insured. However if the accident was the fault of the other party they still have to pay for the repair of your car but the insurance will play every trick in the book to reduce their liability. They will not be very sympathetic towards you. I think you need a solicitor to cover your bum. TELL HIM THE WHOLE TRUTH AND LEAVE NOTHING OUT. THAT WAY HE GETS NO NASTY SHOCKS

You say "If" so I'm hoping this hasn't happened yet. So don't let it happen by not letting anyone drive your car.

But, since apparently it has, you have two separate things going here.

Your car has been impounded for lack of insurance. Do you actually have insurance on the car? If so, go to the towing company, show them proof you own the car, and the insurance card, pay the bill, and take it out of there before it goes any higher. If you don't have insurance, go get it and follow the above advice.

If the bill for insurance is something you can't handle, call the tow company and see what it would cost to have them tow the car to you.

Second question, can you sue the rental company? Sure, this is America where anyone can sue anyone else for any or no reason if they can find an attorney to help them. Once you do, the rental company will say your girlfriend should not have been driving without a license, and if she had not been there would be no accident. The judge may agree with them, depending on who was at fault in the accident. Here again, if you have insurance your agent will help you, but if you don't you're pretty much out of luck.

I believe you will have to show proof of ins. No you will not be able to sue, because the driver of the vehicle was driving illegally, which in most states automatically makes it her fault.
