No you shouldn't! Well try to be polite, inform your insurence company what has happened, give them the name, address and registration number of your neighbour hopefully they will be able to work it out from here.
However if you neighbour is un-cooperative you'll have to get the police involved! The police will obviously be able to see from the state of damage who caused the accident and therefore inform your insurance.
It may seem extreme and you may not want to upset the neighbour but is unfair for them to take you for a ride like this!
Make sure you get in touch with the police first - and are polite! As they will therefore take your side when your neighbour may turn around and say "No they crashed into me" |

Put it in the hands of your Insurance Co. I had a similar experience with a work colleage, do not go down the small claims way as it is a waste of time and money as I had to have a 'garneshee' put on his bank a/c. in order to get my money, even then it took 2 attempts. |

This happened to my brother and in the end he had to go to the police and report the accident and the police got the other drivers insurance details for him! If you haven't already I would inform your insurance company asap and they will contact your neighbours by letter also!! If the repairs are expensive I personally would not let it drop - you done nothing wrong and they should pay for the repairs - neighbours or not.

They are supposed to give you their insurance details at the time of the accident! Waiting this long could be a wrong doing. It's not your fault though, but you NEED to get this taken care of ASAP! If he isn't answering you within the next 2 or 3 days, I would take ACTION somewhere else! |

You claim on your insurance, and they subrogate against the neighbour and his insurance. You didn't have an accident, the neighbour did.
In most jurisdictions, there is an amount over which an accident has to be reported to the police, by law. In Manitoba, for instance, it is $1,000, and a body shop cannot repair accident damage over that amount without a police report having been made. |

You MUST report it to your insurance company.
The terms of your insurance will state that you must report all accidents regardless of whose fault it is.
From the registration number of your neighbours car your insurance will be able to find out who their insurance company is through the Motor Insurance database. |

the terms of your insurance policy will say you have to report all accidents to them regardless of blame. if you give your insurance company your neighbours reg number they will be able to check the Motor Insurance Data base and that will give them your neighbours insurers details and they can write to them direct - thats assuming your neighbour has insurance. with regards to your no claims bonus you will not loss all 6 yrs. depending of your companies maximum bonus which is usualy 4 or 5 yrs you will normal only loss 2 yrs so go down to 2 or 3 yrs. you will only loss your bonus if your company are unable to recover the cost from the third party insurers. do you have any witnesses that will be able provide a statement ? as it seems that your neighbour may not admit responsibility. |

Notify your Insurance Company immediately. Give them the detail you have and they will write to the neighbour. You must not consider any disagreement with your neighbour. After all, that what Insurance is for.
It happened to me in February last years when the lady who lives opposite our house reversed into my car, just under three years old causing g £1400 damage. It was covered by her Insurance Company and I sold it two weeks later. |

tell your insurance company and furnish them with their registration plate and the details and inform them that they are not showing willing. If you have 6 years no claims bonus then have it protected - it costs you slightly more but it is worth it.

If no luck then you will have to go down the police route I am afraid. |

Your insurers will then contact your neighbours insurance company and get all the necessary details off them. |

There's no way you should have to suffer! If I were you give your insurance company their name and address (quite rightly so) and the insurers can take it further. It sounds like they don't have insurance so it's their fault not yours so don't feel guilty and don't let them get away with it whether they're neighbours or not. |

Unless you can supply some witnesses or proof that they did it then unless they own up you will be out of luck. The only recourse I can think of if they are being stubborn is to call the police, they might be able to match minute debris from your car(paint chips etc.) on the impact point on you neigbours car. |

You shouldn't. It's unfair. You may have to take it to small claims court if they're going to be so stupid about it. You're kind of screwed unless they go ahead and give you their insurance information. Otherwise court may be the best way to do it. |

If they were good neighbor's they would deal with there actions and not run from them. Call the police and report the event that way there proof of the event. Plus it make easier to prove its not your fault and more than likely the police will find out they will have little or no insurance or a bad driving history so their trying to weasel their way out. This will help put you better ground with the insurance company and court if necessary. Good Luck |

Where you stand depends upon the State in which you live. Different Insurance Laws dictate how Insurance works within each State.
Your insurance company or agent should be able to advise you.

If you didn't call the police to have written documentation they don't have to pay you and you can't really do much about it. Even if you take them to court, a judge will want to see police documents. I would call the police and ask if it's too late to report it. You should have called police and filed a report. |

Get a police report fast. If you are in california any damage over 750 must be reported to dmv. If you dont report it you can lose your license. Neighbor or not call the police before you lose all your rights to sue him. Do this fast!!!! He is stalling cause he probly dont have insurance. You are ptobly breaking the law by not reporting it to local law enforcement |

Edit: Provide the police with the information concerning date and time of the accident plus the particulars of how it occurred. Give them a statement from the dealer your neighbours contacted as well, and that dealers number. Give all of this information to your insurance company, too. Make sure you have photos of the damage to your vehicle and to that of your neighbours vehicle. |
