It will depend on the laws of the state where the accident happened. In most states, the party that caused the accident is liable for the damage that they have caused. Several states have adopted a "no fault" insurance law, which basically says that each person has to pay for their own damages.
No fault is supposed to reduce insurance costs, because there are no lawsuits involved. Ir reality, when people are not held responsible for their actions, they are more likely to be negligent
If you are not in a no fault state, and the accident was caused by someone else, they are liable for your damages!. |

In Washington State, if YOU get hit and YOU don't have insurance it is automatically YOUR fault for being negligent. |

Possibly, call your state insurance department to see if being uninsured negates your rights to a claim. But be aware if you are uninsured, in ANY state, the other company will either not pay for a rental car or will require that you pay for full coverage through the rental company up-front. (And they usually require cash.)
No insurance company owes you for something you should have legally had in the first place, regardless of fault. |

Three things:
You won't go through an insurance company, since neither of you have it.
You'll have to sue the other party in a small claims court -
but by doing that, if comes into play that you don't have insurance and you could get in trouble. |
