Let's say someone backs into your car while it's parked on the street. It's not illegally parked and neither is it blocking traffic. It's sitting on your side of the street in front of your house. Your neighbor backs out of their driveway and plows right into your car. They are fully insured and you get all her information.
Would you file the claim on your insurance with the hopes that it would get fixed faster?
I posed this similar scenario a few weeks ago because I'm faced with this very problem. The girl across the street hit my new car that I've had only about 4 months. This was late December and here it is abotu to be Feb and my car still hasn't gone to the shop.
Everyone from my earlier posts said I should just file it on my insurance (GEICO) and let them go after the neighbor's insurance.

I'm still waiting on the check to come so I can put my car in the shop but every time I call I keep getting one excuse after another. I talked to a girl earlier this week and she told me they mailed the check on 1/6 but for some reason that check got lost. She put a stop payment on that check and told me she was gonna over night me a check Thurs and I'd have it Friday. Well, today is Friday and still no check. Upon talking to the girl she said the check just came across her desk and it hasn't been signed so she's gotta get it signed and hopefully she may be able to get it in the FedEx drop box today or tomorrow. Meaning I could have it tomorrow or Monday at the latest.
Given their track record I'm not counting on the check showing up. The girl on the phone told me to go ahead and put the car in the body shop and just wait on the check but that way they will end up paying for a rental for 2 or 3 extra days until that check comes. I'm trying to save them money by waiting till I get the check.
At what point can I file a small claims case against this girl? It's been more than a month and I've never known an insurance company to drag this out this long. They've already accepted fault in this.
Not sure if this means anything but the girl's car across the street now is sitting in her driveway with no plates on it. I'm not sure if they've dropped her or what but she had coverage back when she hit my car and now she's not even driving the car.

Why should I go through my insurance company then have to may my deductible then see if they can get it back? Yes, I notified my insurance company of the accident and they gave me two options. #1 - Go through them, or. #2 - Go through the other insurance co. They even told me that there's a slim chance that they may not get back all the money from the deductible. That's a crap shoot.

From what it sounds like,the other girl was probably stripped of her insurance with the fact that she was in an accident, and she was probably told not to drive with the fact that she might have been a newer driver, and it is possible that this is why she either decided to hand in the insurance, or she had to mandatorily give it up.
You should go after her company with the fact that she is not really doing anything to remedy the problem. I would sue her if things don't go well. |

I cant answer your question fullly, but make sure you find out about the laws regarding cars parked in your street. We had a big ordeal where I lived where a neighbor complained and now its illegal to park our car in front of our house because it would be in the street, so we have to park in a lot a little away (we have 3 cars and a small driveway :P). |

It's always best to notify your insurance company regardless of filing a claim. Helps in cases where the other person calls your company and claims you were at fault and tries to "muddy the water".
Unless you have the money needed to meet your deductible, I would stick with dealing with Geico. However, I would call them and get a tracking number. If they cannot provide one, then they did not send the check. Tell them you want to pick up the check and if they tell you that is must be mailed, then CALMLY and politely tell them they have had more than ample time and that if it doesn't arrive by (set a day/date), they can expect a call from your attorney about expediting the matter.
Usually at that point, they get the message and you get your money or you find out that they're blowing smoke up your **** and it's time to contact your insurance about a claim and letting them deal with Geico. |

Even if you are not at fault you always file a claim through your insurance company. That way your insurance knows you were involved in an accident and they can have an agent represent you. Also since you weren't at fault the person's insurance company who was at fault is responsible to cover your repair deductible on your car and your rental car costs as well. You will have to pay them up front but your insurance company will go after the at fault insured company to reimburse them (and you) for any and all costs associated with the repairs of your vehicle.
Also if your vehicle is financed your insurance company would have to let the leinholder know that the vehicle was in an accident and is being repaired. The laws vary state to state of course. |
