That is a tough one. Depends on a lot of different scenario's. Just because someone is backing out does not necessarily make them at fault. That is usually one for the insurance co experts. |

Not knowing what state or province or even country you live in, nobody here can answer with any certainty that you can take to the bank. And even then, it depends on how you were parked. In my state, if you weren't legally parked, it doesn't make much difference who was at fault. Your insurance takes care of your car, their insurance takes care of theirs.
I'm a little surprised that they didn't cover this in the classroom portion of your Driver's Ed class. |

This is tricky.
If your car is not moving, then there is a GOOD chance the other person is at fault if you go to court. If both are moving, you may lose. Usually, whoever hit the tail end of a car is at fault. This is because you are looking at the car in front of you. Hope this is not real for you. |

Generally speaking, the person backing is at fault as they are not supposed to start moving until it is safe to do so. Hitting someone would be a pretty good indicator it was not safe to do so. |

who ever hit you, unless you backed in to someone else,if you was setting still,and someone backed in to it,they are at fault,you have to have a police report on this either way to let the insurance company settle out on it,good luck on it. |
