If someone rearended my car, how is the procedure to ensure they pay the bill?

My car was rear ended by a lady in an SUV. I agreed we could settle it out of insurance, so I got a quote.

Her husband called (who happend to be a cop..weird luck..but true) and he agreed to pay the quote I faxed him.
I could go through insurance if necessary, but wont. How do I ensure he pays the dealer repair for about $600?
Do I get him to write an agreement? What is the procedure to make sure he pays?

Any advice would be helpful...so far everything is ok, but I want to pin him down.

Id rather not go through insurance myself, even if Im not at fault. These add up, and insurance companies can jack up rates arbitrarily.

yes i would have him write out an agreement and sign it,,just to make sure ,,you cant be too sure in a case like this,,it can get tricky when dealing with a accident if i were you i would record him saying it,,but it may be to late for that,,just go about it the best you can,,since you was hit in the rear end,,it is their fault,,so you have the upper hand in this deal,i hope this help,s good luck with it. he didn't exactly handle this right ,,so you can report him if you need to do so,,just use common,sense,,and be calm about it,,if you loose you cool your not going to get anything done good luck,,i hope it works out good for you.

You should just let your insurance company handle it. It doesn't cost you anything. And your insurance company will subrogate against her to get the money back.

You file the claim with your insurance company. They will collect from the other driver or their insurance company. Since the other driver is at fault your rates won't be affected. You're paying for your insurance to do this for you. Now let them do their job!

You don't get ANY kind of agreement with the other driver! Your insurance policy warns you not to do this -- read it!

If he doesn't pay-up, then simply file a claim with your company. Really not a major deal unless ins demands (as is their right) to inspect damages BEFORE repairs are made. Take lots of QUALITY photos --

First of all you should have called the police.

Unless you have witnesses you have no enforcement unless he signs something.

If he don't pay then you go to small claims court.

Next time call the cops and make a report.

Type up some kind of agreement and have him agree and sign it. That way if he screws you, and you take him to court, you have proof that he said he'd pay for the damage he caused.

Get the money first. If you can't that way, I would have him sign a contract or go through insurance. If they decide to breach the contract, you would have to take them to small claims court to get the money.

Well, if you aren't at fault, then your rates won't change. After all, that's what you pay for insurance for. The look after the details, get the money from the other person's insurance company. What's the point in forking out hundreds of dollars for insurance if you don't use it. Was it the cop's idea to do it without insurance? If so, it cuz he doen't want HIS insurance to go up....and may be trying to rip you off. Just because he's a cop, doen't mean he'll be honest with you. Believe me, I was married to one!!! Please get all your info from the police report filed at the time of the accident, and the name and policy number of the other side , and get in touch with your insurance company. You can be sure your ins.company will look after you.

Get his badge name and badge number(if he is a cop) What he's trying to do is illegal!!!! Any damage over $300 requires you to fill out an accident report within 72 hours, by law!!!
You could remind him of the law, if so desired.

Don't have him pay the dealer - have him pay you directly. That way you know you've been paid. And if he does, ask for a cashier's check or money order, so a personal check doesn't bounce.
