no lectures pls. basically my friend only just got this car and the change of ownership has only gone thru she hasn't gotten round to insuring it and last night she got hit and it was entirely the other drivers fault. she doesn't have a policy and was wondering if it would be a problem for the his insurance company to fix her car. thanks for ur help

Assuming you are in the UK then the fact that she hasn't got insurance does not affect the liability of another driver - so she will be able to make a claim for the damage (and injury?) she suffered. |

she isn't insured and is in big trouble with the police driving without insurance is a very serious case, 6 points probably and she will have to pay for the damage caused by the other car, what a plonker she is.. if the police arnt involved do tell them |

If she was uninsured, then she's liable to pay out. She doesn't have any insurance so it will come out of her own pocket. Also, if the police find out, I'm sure she could be in big trouble for driving without any insurance. |

Yes it would. Uninsured driver in collision with insured driver, she doesn't have a leg to stand on, will be deemed at fault, and will have to pay for her own damage, and damage the insured car too. Life's a ***** innit? |

I am afraid that no insurance company will pay out for her if she was not insured herself.
They will check as a matter of routine, you must know that they do not need much of an excuse to get out of paying.

your friend is bang in the wrong and with no inrurance to cover the accident she is left stranded!! i sugest that she pays for thoe other car to be fixed out of her own pocket!! bring it to a garage of HER choice ( not the the other partys choice of garage ) get a quote and get it done without bringing cops into it!! if not this will appear on her licence and when getting a qoute for insurance in time to come she will get screwed and maybe even lucky to get insurance at all!!

The answer to your question depends on what state your friend lives in. Some states have laws that prevent uninsured people from collecting from an insured person. However, there are states that don't have these laws. Thus your friend will be able to collect from the other driver. |

Can we please clarify whether you are in UK or USA? then we can put it straight, if you are in the UK your friend is SCREWED, she will not be able to claim from the other parties insurance and will have to pay the other parties expenses out of her own pocket, the police will have to be informed by the other parties insurer that the accident involved an uninsured driver. |

If the at fault driver has valid coverage for the date of the accident, then his policy will cover the damage done to your friends car. It would not matter if your friend had insurance or not, he is still liable to repair |

It doesn't matter if she hadn't got round to insuring the car! She is at fault because shes driving illegally on the road without it. The other cars insurance will not pay up, if anything they will come after you for the repairs? I'm also surprised this hasn't gone to the police which i have no doubt will once the insurance company start. You will then get a producer for MOT, Ins etc. Which you carnt, which means a fine and points on licence besides what ever else the police want to through in concerning the accident. Ouch!!! If the other person is at fault, and there insurance company accepts liability it doesn't matter if you had insurance, or not, as long as they are accepting 100% liability, if there not then there could be an issue, or if your state is a mandatory insurance state, usally if its a new veh purchase, or replacing one on current insurance policy, then policy from the replaced veh will carry over to the new veh for a period upto 30 days, until you notify your agent. |

your friend was committing a traffic offence by just being on the road. therefore as it was an illegal journey the other driver's insurance company is not obliged to pay for any damage to your "friends" car. In theory you may be able to sue the driver individually but in practise you will struggle to get a solicitor to work the case. It is entirely possible that the other driver or their insurance company will report the incident to the police |

wow, a lot of people seem to be sending info to you on stuff they just dont know about. IF the other person is found to be at fault, and you do not live in a "no fault" state, then the other parties insurance WILL pay to fix your friends car. IF that person was at fault, it does NOT matter if your friend had insurance at the time. She may have been cited by police (if they were called) for not having insurance and that ticket will stay on her record for 3 years. She needs to contact his insurance company and see if he has filed a claim for the accident. if not, they can open one when she calls. they will contact their insured and get his side of it and get a copy of the police report. If they did not call the police and have a reposrt done, she is probably going to be SOL. |

Not a problem, you have 30 days to get coverage. Never the less her insurance does not matter when someone else hits her. Her insurance is not effected at all. |

if she hasn't got insurance she shouldn't contact the other drivers insurance company because they will look into your friends records and find out she was uninsured and will defo be hit with a bast.ard of a fine |

Just so you know, insurance is not a law in quite a few states in America.
Whether your friend has insurance or not, that does not clear the other driver of responsiblity of restitution for damages.
Get a lawyer. Do so NOW, and do not wait.

You know, you pretentious morons, that some folks really cannot afford insurance. Perhaps that payment could do the light bill this month. Perhaps that father of three whose wife left him with the kids could use the money to feed his kids because he only gets 15 dollars an hour!
