I was rear ended a few weeks ago and the other persons insurance paid me to have my car fixed. I am scheduled for next Monday to get it fixed. Today almost got hit again. That got me thinking, Had I got hit again, could I have kept the money for the first accident and get the car fixed with the second? I know this isn't ethical, but is it legal? Anyone know?

If you had gotten hit again before fixing the first damage, a good adjuster would have subtracted the first damage. It's been my experience that most adjusters have been fairly generous, unless the check goes direct to the body shop. |

Generally if something isn't ethical, it's not legal either.
You should be smart enough to know that.
The money from both, MUST go to the car. Otherwise, it's blatantly fraud. |

Everything is legal till you get caught. And no it must not just go to the car. Many ppl make claims and never get the car fixed. You just can't claim the damage again. |
