Car #1 was an audi sprort car, car #2 was a 03' chevy suburban and car #3 an 04' jeep liberty. A police report was given to each at the scene on 10/1/07 in Licolnwood, Il. Car #3 initially went thru car #2's insurance but was told to go thru car #1's insurance but am being given the run around by both. Car #3 was the one hit and not at any fault but have yet to receive any info from either parties. This accident has been reported to car #3's insurance but #3 would rather go thru the other insurers companies to keep from paying a $500 deductible and a possible hike in premiums. Incidently the driver of car #3 works for a company that publishes tax & insurance laws and was told by one of the publishers to pursue both insurance companies and that car #2, in order to rear end #3 was either going too fast or simply too close. I was at a halt because it was stop & go traffic and so I'm assuming car #2 was as well & I'm not sure where car #1 came into play. What should car #3 do?

The last car in the line has no liability to anyone else, and goes through the insurance of the vehicle that hit him. Car 2 would have a claim against car 1 for their losses, that is, the back of their car, but owes you for the back of yours. Car one may ultimately owe everyone depending on the actual facts, but owes number 2 for the back of his at the very least.
You did turn this in to your insurance, didn't you? They should be the ones getting things to the point where you are made whole, you shouldn't have to get a run around from either company. Call your agent and make sure they are working on it for you. That why they make all that money every 6 months. |

Cowboy is right about how this will play out.
Assuming you are car three, don't bother with car 2 at all if they did not hit you first. If you only felt 1 impact then odds are that car #1 pushed #2 into you.
The #2 is not responsible for your damages if they were stopped or slowing behind you and then car # 1 pushed #2 into #3. Anybody who tells you that car #2 was to close to you is obviously not a claims adjuster. If you were stopped behind traffic it is not reasonable to expect each car to stop 2 to 4 car lengths behind the one in front of them.
Car #3 needs to either collect from their own collision coverage and then wait a few months to get the deductible back or collect directly from car #1for all of their damages.

If car 1 hit car 2 and pushed car 2 into car 3 then car 1 at fault. If car 2 hit car 3 before car 1 hit car 2 then split liability. As long as car 3 says they only felt one impact then car 1 is at fault, unless you live in a no fault state, then to each there own.. |

The first car who hit the 2nd car is at fault . If not for thier lack of keeping thier car in control none of the rest would have happened...... They should have been citied for failure to keep thier vehicle under control...thats the law !!! And if the police didnt cite them or at least warn them then he/or she was in the wrong . Car No#1 is at fault and thier Insurance should pick up the tab of the other two vehicles period !!! |

You are responsible to keep a safe distance between you and the next car.
Car number three would have no fault here unless you stopped suddenly. Like you dropped a cigarette ash in your lap and stopped short. You could have some contributory negligence.
Barring that. If you were smacked from behind then the person behind you is responsible. You could go after both. If the insurance companies don't pay up or quibble sue them. If it is small enough usually under five thousand go to small claims court.
You must prove your claim and show damages. You would need a police report and any witnesses. Damage reports or actual payments. Doctor bills. The best thing is sue everyone involved. and let the judge sort it out. |
