Next time, keep a checklist in the car. Everyone can get rattled under stress.

1. Call ambulance if injuries. Take the person out of the car if it is burning.
2. Call police if injuries or extensive damage. Write down the telephone number to the police for nearby cities and towns (better than calling 911 which sometimes goes to a sheriff or state police)
3. Look up insurance companies websites and see if they have an accident report. If not, look up your state DMV. Print out the form and keep it in the car. If you have the form, then you can fill it out at the time. If your writing is messy, you can always copy it later on a new form.
4. Carry a pen in the car. Better yet, 2 pens and a pencil.
5. If there are witnesses, get their name and number.

See the link below. This form is for Massachusetts but the information that you get (name, address, etc.) is good to know for any state. See Section D. Circle it in red. That's the most important info to get from the other driver. The rest, you can get later on by yourself.

You are suppose to get driver's license number, insurance number, plate number, name and address and phone number. Also the time and location of the accident and names of any witnesses.

But if you can't remember all that during a stressful AFTER accident time, just member to call the police. They will get all that and give you a report.

* Stop your vehicle if it is clear, safe and legal.
* Move the vehicle out of the traveled roadway, if it is clear, safe and legal. (In some states it is against the law to move the vehicle from the place where the accident occurred. Check the ordinance in your area.)
* Turn off the ignitions of the cars involved.
* Make a first aid check of all persons involved in the accident.
* Call the police and, if necessary, emergency medical services.
* Mark the scene of the accident with flares or retroreflective triangles.
* Gather the names* of all persons in the motor vehicles and people who witnessed the accident.
* Make a quick diagram of where the vehicle occupants were seated and indicate the vehicles' direction of travel and lane. Also note the date, time and weather conditions.
* Ask to see the other driver's license* and write down the number.
* Exchange insurance company information. DO NOT discuss "fault" or make statements about the accident to anyone but the police.
* Get a copy of the police report of the accident from the local precinct.

Whoever hit your brother will likely get a bad memory fast, assuming they even gave him the correct name and number. He has no proof the guy ever hit him. It's best to trade insurance information. At the very minimum get the license plate, you can get it without the other person cooperating. Even better to have a camera handy and take a picture. With cell phones these days, one is usually available. Just get some proof and your insurance company can piece together the rest of the story. If your not at fault, you want to find the guy who is and so does your insurance company. You're on the same side, get the information to help them out.
