In an accident how can i prove that the other person involved in the accident was guilty? ?

Today i was driving down a busy road when this women,coming from a side road suddenly decided to push for a pass through.I was driving on the main road it was heavy traffic and i had maybe 10 miles per hour.i managed to stop but i made i little scratch on her bumper and my.So she wants to claim damage on my insurance saying that is my fault i didn't give HER priority.Can she do that?

The thing is i didn't bump in to her, we stopped front bumper to front bumper, there are no dents, just couple of superficial scratches on the bumpers.

The police report, it should be noted on who hit who. If you hit her you are responsible, no matter why you hit her. This be unless she ran a stop sign, traffic light, etc.

Try to provide more scene description. Did she have a stop sign and you didn't? How did you know you were a main road and hers wasn't? It sounds like she thinks she was on the main road. Where exactly are your damages and hers... like middle front, right front, etc. More details are needed to determine who's fault. You'll need to be very detailed. See if you can find any witnesses that may have seen it.

you need to know who had the right of way and it is always to have a disposable camera to take pictures as when you move car it is difficult to determine who was where etc

Your insurance company should sort this out for you and they wont pay out for her claim unless they are satisified it was your fault.

As long as you have reported it to them and told them it wasn't your fault there should be no problems and they should let you know ifthey intend to pay for her claim.

The fact that she pulled out from the minor road means she is at fault, it doesn't matter if you hit her because she reduced your stopping distance by pulling out on you.

if she had a stop sign and didn't properly yield than she is at fault... if she was trying to push through when there was traffic coming she is at fault but you need to check the at fault laws in your state some states determine percentages of fault ...like she was 45% at fault and you were 55% at fault or vice versa.... if there was no damage and she files a claim she is hurting herself also unless she has no deductible to pay out of pocket... call your insurance company and ask them all your questions that might help

The police will determine this from evidence of where the dents are and where the cars were hit.

unfortunately since by your own description, you hit her, you are most likely at fault technically, even though it sounds like it was her fault. A police report would help, also if you can find any witnesses that saw the accident, that will help your case as well.
