I was in an accident I was not at fault at all. I owe 5400 on my car and the woman who hit my car was at fault and totaled my car. Her insurance company will only pay 5000 and I still owe 5400 that's after the 1800 I already paid on the car. Is there any way i can sue her for the total 7200 and win the case? Can i get any more money for the inconvenience?

They don't care in the slightest.
They will pay out for the value of your car.
If you owe more than that, that is 100% not their problem.
What are you going to sue her for? The fact that your car was less than you owed? Wake up a bit. Tons of people are upside down in their car loans. That's just the way it goes. |

Normaly the insurance companies go off of what the car is worth before the accident. Even tho you may owe 5400 on the car it may only have had a retail value of 4200. Best bet would to present your case to a lawyer and see what they say. |

How much you owe on your car has absolutely nothing to do with what any insurance company will pay to compensate you for your loss. They are only obligated to pay the actual cash value of the car, based on its condition just prior to the accident. If you owe more than that, that is not their problem. |

Insurance companies have an agreed value for each make and model of car. They will only pay what their book says it is worth, not what the repair guy says.
Check with your own insurance company if the 5000 is the book value for your car |

most of the time insurance companies will screw you over. i do not think you can sue her because that is the total worth of your car so therefore they will not let you get any more money |

I would advise you to call a lawyer and also go get your self completely checked out medically. You know those headaches that you have been getting and the back pain may have been caused by this accident. You have 2 full years in most states to file a suit but you shouldn't wait to get medical treatment to long because they will try to say that you hurt yourself after the accident and are now trying to blame them. If they don't want to play fair stick it to them hard. You are already being to nice. You have the right to the best medical and they HAVE to pay for it. |
