Insurance company CHANGE THEIR MIND on whose fault it is?

i was reared at a red traffic junction in may.
and the insurance company said it was not my fault. duh my car was at a complete stop.
and suddenly i receive a letter saying that my driving history changed and the accident in may was my fault?
what is going on? it said the source of that report was from the MVR
advice anyone?

i called the insurance company and they said they weren't making me pay a higher premium cuz to them its not my fault but to the MVR it was.

Time to take it to court. Battle it in court with a good lawyer.

Their insurance is trying to convince you to take the blame. They won't pay for your car if you don't fight it.

Your driving record did not cause the accident. The driver who rear ended you caused the accident and his insurance should pay. Have you considered using your own insurance to fight for you (it's free) like you should have in the first place ? If not, call them now and they will fight for you or you will have to Hire a lawyer on your own

The reason they gave for claiming you were at-fault does not make any sense. are they saying you were charged at the scene with an offence? What was the offence? What does your MVR say that caused them to reach that conclusion?

Did you go directly to the other party's insurance? If so, your insurance does not have a copy of the report. It sounds like you got your renewal policy & since the accident showed up on the MVR, they are surcharging your policy. The MVR never states who is at fault, only that you were involved in an accident on a certain date. Unfortunately, in this case, insurance companies will automatically add a surcharge until you prove that you were not at fault. This does not mean they changed their minds.
All you need to do is to prove that you were not at fault and the surcharge will be deleted back to the renewal date. Proof can be in the form of a police report (must be clear cut, this cannot have 2 different stories by each driver) and/or the letter from the other insurer that they paid your claim (usually you get a letter with the check giving a breakdown of what was paid).
