I rammed into the back of another car on a really wet morning on the freeway back in October. Apparently the damage was $3000 (AUD) and RACV have been sending me letters threatening to take me to court. I sent a letter back trying to say it wasn't my fault (even thought it was) and told them I'm not going to pay. They haven't contacted me in 2 months. Will it disappear??

It will not go away. They will file suit against you. You will end up paying once a judgment is found against you. I suggest that you contact the insurance company and work out a payment plan. If you have insurance, refer the matter to them. That is why you should have insurance. Not paying timely will also have an effect on your credit score, if you care about that. |

No. The insurance will sue you -- HARD and you will be given a summons to appear in court. If you're stupid enough to not show up then a warrant will be issued for your ARREST. You need to contact the insurance company ASAP and make a deal with them to pay the money back. If you don't a judgement will be levied on you and you will be forced to sell your assets and your wages will be attached until all costs (including $1,000 in court costs) are paid in full. This guys do not fool around. |

It will go on your credit report, they will never go away. The debt may show up years later when you apply for a home loan. Contact then and say you can make small payments, they will deal with you. If you can afford it, offer them 50% they make take it as full payment. Just get the deal in writing before you pay. Your conscience will always bother you, do the right thing. |

They will put a lien on you and when you try to buy a house it will pop up. If you have a common name I guess you can say its not you. |

hmm, it might be a scam, or maybe it isnt. it depends on how big this company is. If its real big, u can be sure ther up to somethin and should contact ur lawyer, if its a small time company, i dont think u should be stressin it but contact ur lawyer anyway and explain the situation to him. But also he shoulda had insurance which shoulda coverd the damage. What I recommend you doin, as ive already said, contact ur lawyer, he'll tell you what to do. |
